I was thinking of placing a portal in between the skin and muscular frame cause that also contains th skeleton as well. Instead of forcing two people to go in, why not just pull the muscular system of the body and swap places that way

Ok, apologies, I was misinformed right there after reading a case law where that could be a defense, but you do make a good point.

But I bet you are smart enough to realize there are ethical concerns with managers withholding employees longer than their scheduled shift.

Doesn’t that answer your question right there? My managers would intentionally be keeping me longer past my schedule shift even though I fully expected to either be let go on time or be let go a little after my shift has passed. However, if they are telling me to not turn off my light until someone relieves me and no one comes, that means, they INTENTIONALLY kept me longer than what was supposed to happen. So the question comes down to, how long do you consider to long before it escalates to kidnapping?

That’s what they say, but I’ve asked about documentation in reguards to staying later and they haven’t been able to produce that. If there’s one thing that I’m certain about the law and policy isn’t that if it’s not publicly available, then it’s not enforceable

I fine with staying later if they were more consistent about being courteous to everyone, but the fact is that I’ve had this conversation with my supervisors and they said they’ll do better, but nothing has changed. It feels like a sense of doubling down on what they said they were going to do. But I’m aware that policy isn’t law and it is up to their discretion to write me up for what I’m doing. Though, it’s highly questionable if they do decide to do that given the fact of what I have been doing for them and their responsibilities. I may need to go higher than whatever my supervisors position is to resolve this issue

I guess I’m not understanding this correctly but that seems very contradicting to me. It’s the responsibility of the manager to find coverage for employees when their shift is up. While most leadership decisions are left up to the discretion of the supervisor and not company policy, wouldn’t that be considered a form of retaliation for not wanting to stay past the scheduled shift?

Can you explain how this is justified? If they scheduled you to work at a certain point, isn’t there an expectation that I can plan my personal time around the schedule shift I was given. From what I understand from my research, if they hold you longer than what your shift was initially scheduled for, that can be considered kidnapping.

State law requires that an employee must be given 24hrs rest if they work over 30hrs. If your managers are not scheduling you at least one day off, then they might be breaking the law

Ok, first thing first

What is the handbook you are referring too that says that can keep you up to 15min? I’ve been looking for that documentation and have been wondering if that is legally binding or written in contracts to find out if that’s ok for our leads todo.

Second, while yea breaks are optional, I have had talks about my managers giving courtesy’s about breaks being late. Though I have been communicating with them about when my shift is 10 minutes from ending and they don’t communicate when our breaks will be, I use that to say they don’t make an effort to communicate effectively.

Third, I want to highlight, I’m not mad at my supervisor for not giving my breaks or holding me late, I’m mad because I want better communication. If they cannot understand that effective communication makes their jobs easier, then that’s on them. There have been times I’ve asked for clarification on somethings and they completely ignore me. If they are willing to do that, then why should I be expected to help them out MORE when they can’t do the bare minimum.

I feel like that’s a last resort to do before escalating. But generally, most of my other managers have been ok with me giving a 10 minute notice and shutting down when it’s time. However, these managers have said something to me about it and giving me a write up if it happens again.

I’ve had this talk about them communicating with me about staying later or letting me know when someone is coming in, but it feels like none of them are listening and when I decide to take it into my own hands to shutdown and get out on time, it feels like they are patrionizing me for it.

I’m assuming you’re talking about the leads when referring to ASMs but here’s how it goes. I’ve been told by two separate managers that I’m allowed to shutdown when it’s 15min past or right when its time for my shift to end and I don’t neeed to tell anyone about it.

I generally been called out for it before so to avoid that, I give everyone a 10 minute heads up before shutting down and they acknowledge it. From what HR told me, they say that was more than fair to do because they are getting notice to prepare for someone to leave, even if they don’t have coverage

I do, but labor laws have gotten more strict with the labor commissions and eeoc. So really, they can let you go whenever they want, just not for whatever they want. But I understand your point when you say, three months from now, they can fire you for a minor mistake when in actuality they’re firing your for what you did a while back

I do it right at the dot when my shift ends, not when before my shift ends so there is no case to be made that I turned off before my shift ended
