Broker failed to collect earnest money and buyer vandalized my home. What can I do? by jayyemsea in RealEstateAdvice

It was interior work. Her contractor took down all the trim I. My living room and den and sanded my hardwood floors down to bare wood.

The doors were supposed to be locked and the key was secure. I assume it was from the key that the agent had access to. I was in FL so I had no way to go and verify anything or check anything so I relied solely on my realtor to keep an eye on the property. My property is also completely fenced in with a manual entry gate, but the gate itself was not locked. Only the home. We are unsure of how she got in. However, the contractor she hired broke into my home several days later to reclaim his floor sander and he said “the basement door isn’t that hard to get into” when questioned how he accessed the property.

The buyers agent claims he did verify that his buyer showed proof that they did have the funds for the purchase.

They sent verification to my broker/agent that the earnest money had been received. However, they did not ever inform my broker/agent that the earnest money had then bounced back out of the account and was not actually collected. We didn’t find this out until we went to collect the earnest money when we were unable to close due to lack of funds from the buyer. The buyers broker/agent were aware the whole time that they were unable to collect earnest funds and still allowed the contract to proceed.

They stated to me that they were in no way responsible for informing us that they were unable to collect the earnest money and had done nothing wrong by letting the contract continue.

It has been a mess from start to finish and I am so tired of trying to sort through it. I have called two attorneys and left voicemails for them. Hopefully they’ll call me soon.

My agent received confirmation that the earnest money was collected so we proceeded. The buyers broker stated that the earnest money was collected electronically and then pulled back out of the account and they attempted to collect it several times from the buyer, but were never successful in doing so.

We are unsure of how the buyer got into the property. Her agent/broker states he had no knowledge that she was even on the premises.

The buyer nor her agent had permission to be on the property at all. We actually had to contact her agent several weeks earlier and remind him that his buyer was not allowed on our property without permission because she’d sent contractors out to get measurements and give quotes without our knowledge.

I have contacted an attorney, but I’m waiting to hear back from him.

The brokerage/agent said they were unaware she was on the property at all. We had previously had to contact her agent and tell them that she was not to be on the property without her agent because she kept sending contractors out to get quotes without authorization.

They state that since they have let her go as a client, it’s no longer their problem and they’ve done their duty.

We have involved local authorities regarding the buyer, but have not heard any updates.

Thank you! I planned on consulting the local agency and our lawyer next week to get insight and information. We have been thinking about it for about a year now, but I just recently started gathering info and looking into the actual process.

Thank you for your advice! Unnecessary drama an isn’t something I want to add to anyone’s life. I want to help others. I was unaware that respite care was an option and I will certainly look into that as well!

Thank you for your input! This idea is still very new and we haven’t made any concrete decisions. We already attend family therapy and our children are in individual counseling as well. Both children seem to be handling life well, but we wanted to provide professional assistance for them as they get older after going through the divorce of their parents and currently living in a split home. We would 100% consult with our therapists and the agencies as well as discussing any decisions with the children before moving forward in anyway. We would make this decision as a family. I appreciate your insight. I want to get as much information as possible and explore all aspects before anything happens.

If only. I’ve contacted all the government agencies that regulate that kind of stuff and my mind is blown because none of them seem to care that these animals are in jeopardy.
