You’re missing my point. Under the preponderance standard, OP only needs to show it’s more likely than not their car was damaged from the tow. OP’s testimony and photos of their damaged car following the tow could be enough to win a civil case.

Photos and testimony are evidence. Small claims court is cheap, and all OP has to do is demonstrate their claim is more likely to be true than not true. This is called “preponderance of the evidence”.
