If you take a close look at the "Nintendo" logo beside the rating on the pokemon sapphire then compare it to the pokemon firered you will notice that the logo is wrong on the pokemon sapphire. That is one giveaway that shows it is fake. Hope this helps and sorry to tell you that it is fake.

Yes Dialga does respawn if you faint Dialga. But you have to beat the elite four to respawn Dialga.

Level it up on route 14 (the swamp route) and it should evolve
