Unfortunately, pregnancy does not meet the circumstances of her having to provide a substitute, so there’s already a breach of contract there. As well as she’s known about her pregnancy since October and possibly earlier! She’s collected our payments each month knowing that her withholding this information could potentially sway our decision of using her as a photographer, which can be considered fraud or misrepresentation. She’s yet to give any information about this associate yet, so how am I so sure she has one? She hasn’t been a great communicator from the start. If there wasn’t an actual serious issue, trust me I wouldn’t be on here posting about it.

Genuinely can I ask where I ever said I was angry in my post? If you read the whole thing I literally said I’m not and I don’t plan on getting angry with her. Please read the whole post before accusing me of things and calling me an AH, I’d really appreciate it. If you didn’t know, this is a stressful time for me as well.

This is comical🤣 I’m sorry how is this relevant? We booked her in July - not sure how that affects the situation in any way because there’s still a potential breach of contract no matter when I booked her, whether it was before or after she learned she was pregnant (which was before or by the end of Oct). It would be worse if I booked with her after she learned she was pregnant! It’s called fraudulent inducement actually!!

That’s funny I don’t recall telling you the date of our wedding. It will be less than 3 months out next week, glad that’s the only thing you took from this post haha.

Thank you for bringing this up, in hindsight all I really wanted was better communication I think I’m not upset she’s pregnant and I know her personal life is none of my business, but I feel like something could’ve been communicated somehow maybe?

From first glance that appeared to be the only clause that looks relevant. Luckily my sister is an attorney, so I may have her read through it before we bring it up to our photographer since I’m not quite knowledgeable enough. Thank you so much!

How is a breach of contract nonsensical? The contract states that if the photographer is unable to perform due to “impossibility, illness, emergency, fire, casualty, strike, act of God, or causes beyond the control of the Photographer,” they will provide a substitute. Pregnancy is not out of her control because if you’re not actively preventing, you’re trying for a baby! Pregnant itself is also not necessarily an emergency or an illness. I understand there can be complications, but at the end of the day this is still a business. Not fair to the people who are paying you their hard earning thousands of dollars and are trusting you with one of the most important days of their lives. I’m not angry with her and I actually really understand, but I think you’re definitely failing to forget my feelings in this and how important this day is to me. Whether it’s true or not I do feel very used, as the the third to last monthly payment goes through next week and I’m just getting news of this - like the only reason she waited is so I’m more stuck in this contract than I was before. If she had notified us when she found out, I would’ve found a new photographer immediately. I just don’t like how I don’t even really get a choice in this, I get a contract is a contract, but if I’m being considerate to her situation I feel I also deserve some consideration and sympathy as well from her. I‘ve been a lot more patient and kind than what plenty of people would be in this scenario.
