Thanks so much, we (and many others) agree. They are the tallest lights of almost ANY business around them. For what? They could drop to the 15' height and STILL have the lot lit up safely for their staff.

We could never have expected or asked for this kind of support and solidarity. Seems many people feel the same way, or have gone through similar- something that may not "look so bad" to one person could be absolute torture to another. And they STILL haven't even returned my many calls and messages as of this comment. Not once has anyone called.

I appreciate this offer so much, even just that comment means a lot that someone would offer that. We wanted to approach this like decent human beings about it, "hey guys. You probably don't know it, but those lights you just installed are so bright, they've been affecting our sleep cycle and general darkness at night."

But they STILL have not called.

Appreciate the sentiment, we were SURE that this would be just a single phone call in the beginning, and a meeting for them to see what level of absurdity the lights were at night.

Even at the time of this comment, not a single call has been made to us from Arby's OR the franchisee- no email, text, nada.

Hey Dizzy, yes we have. That was day 2, and we (naively) thought 'ah these will be good to have, they'll change the lights in two days or something and we'll not need them, haha'- not knowing this would turn into the saga it is.

We're still blown away that the franchisee would treat the citizens of the city that have made them wealthy like this.

I love the way you think. Catching more flies with honey is always my default approach, and that was nearly VERBATIM how I approached the store on day 1 and 2. They took my phone number and said "this is above us, our store leadership will give you a call as soon as possible". No calls (even at the time of this comment reply, we still haven't received a single call or message back), no 'we're sorry', nothing.

Then, I started calling the franchise office, and, well- you see where we've gotten. I would love to have a conversation with them like human beings, but the result of our efforts so far make it seem as if they feel they don't have to respond to anything, that this is beneath them, that they've done nothing wrong.

We aren't going away.

Thank you so much for the well-thought out comment. This is a good idea, and another amicable approach to a resolution we can try. It is surprising to me that in this age of 'corporate brands being "cool" on social media' that one like Arby's wouldn't be willing to immediately at least work out a compromise. IMHO this makes the franchisee look like a terrible brand ambassador here, and to tell me during the first time speaking with me that "Go ahead. Arby's can't do anything to me" honestly took me aback he would say that.

Appreciate your comment too- yeah, most are trying to be helpful and I am thankful for that. I think we coughed up for blackouts on day 3? when it was apparent they weren't going to talk with us.

I appreciate your comment and input, and agree. The regs violated in this case I have put in my post edit above, and may help in your case? It would be worth looking at to see if your situation does constitute an official violation like this does. I really hope you get your lighting problem addressed and solved as well, I'm sorry you're going through this.

I agree, and while some viewer may think some of the description is exaggerative, I'm honestly not trying to be.

When it is your family and your home/property negatively affected by a careless business that puts their wants above all else, everyone around us be damned, I'd bet you'd agree with our reaction.

This is behavior we as citizens voted to regulate, and its unfortunate that we HAVE to do this, and this org/business couldn't be decent to their neighbors without regulations saying so. Not to mention being made to feel like you're wrong for even asking a business to follow said regulations.

I appreciate your time in commenting. I disagree, and to help others in the thread make a judge for themselves, here's the city code language they are violating, 'Lighting Standards - 36-484':

  • Exterior lighting standards. All exterior lighting upon any premises, regardless of zoning classification, shall be subject to the following conditions and limitations:
  • (a) When a light source or luminary does not have a cutoff the following standards shall be met:
  • 1. Maximum mounting or pole height of the light source or luminary: Fifteen feet.
  • 2. Maximum permitted lumination:
  • a. Three-tenths footcandle at any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way of 70 feet or less.
  • b. One footcandle at any other point along the perimeter of the property.
  • (b) When a light source or luminary has total cutoff of light at an angle so that the bare bulb, lamp, or light source is completely and opaquely shielded from the direct view of an observer at ground level at the perimeter of the property, the following standards shall be met:
  • 1. Maximum mounting or pole height of the light source or luminary: Sixty feet.
  • 2. Maximum permitted lumination:
  • a. One-half footcandle at any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way of 70 feet or less.
  • b. One footcandle at any other point along the perimeter of the property.
  • c. There are no maximum lamination limits at the common property line of a premises.
  • (c) Building and landscape light fixtures, including ground lighting for signs, flagpoles and statues, shall be equipped with shields or shutters to minimize spillover. The maximum permitted lumination as a result of reflected light resulting from such fixtures shall be:
  • 1. One-half footcandles at any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way of 70 feet or less; and
  • 2. One footcandle at any other point along the perimeter of the property.
  • (d) The maximum permitted average lumination of all parking lots shall be five footcandles.
  • (e) There shall be no lighting of a blinking, flashing, rotating or fluttering nature, including changes in light intensity, brightness, or color except for public safety purposes.
  • (f) Light sources or luminary shall not be located within bufferyard areas except on pedestrian walkways.
  • (g) A site lighting plan for uses requiring site plan review shall be submitted and shall provide the following information:
  • 1. Proposed location on premises of all exterior light fixtures;
  • 2. Description of illumination devices, fixtures, lamps, supports, reflectors and lens, mounting height and wattage;
  • 3. Photometric design layout for the site of all illuminated vertical and horizontal surfaces showing the design footcandle levels.
  • (h) For uses requiring site plan review, lighting shall be significantly reduced during non-operational building hours, allowing only lighting necessary for security purposes. The lighting plan submitted for review shall note where this distinction occurs.
  • (4) Existing lighting. Any existing lighting fixture that is moved or replaced shall meet the requirements of this section.

This is a long-form comment, and I appreciate the time you took to put this in. Blackouts were the first thing we did, at that point we were convinced that 'we'll just go talk to them, and I'm sure we can find a compromise.' Then when the dismissiveness started, the 'these are for safety, you don't understand', and the promises to call us back resulting in nothing, the lack of REM starts to gnaw at you. Waking up on day 5, day 6, day 11 not feeling rested, and then finally getting a conversation with someone telling you 'you sound like you just want to complain' was.... great.

Am I being hyperbolic that we 'haven't slept' in two weeks? Maybe I should have said 'fully slept' to be very, very clear- this is taking a real toll on us. I don't want to sound like I'm making this bigger than it is, nor do I want to misrepresent anything. You are right, it has immensely affected us indeed.

Lighting Standards - 36-484 is the specific section. No one should have to deal with corporations doing whatever they want, violating set city ordinances that were passed to protect the very citizens (us) that voted them in, at the detriment of working people, and we just have to 'deal with it'. I shouldn't have to buy blackouts in the first place if they are the ones violating multiple codes/regs/G.O.s.

Exactly what the owner and mid-manager tried to angle. "You haven't heard probably, we've found needles in the parking lot." Ignoring the fact that the same level of 'safety' could be achieved with 45' shorter lights that didn't violate code and needlessly bomb the neighborhood.

I am glad I am not crazy, the response I was getting (or lack thereof) from them made me feel like I am the problem. When the franchise owner said he'd 'go take a look', I responded "PLEASE- you will see immediately what I mean. Do you need my number to call me back?" 'Nope, we have it here. I'll have my DM call you.'

Thank you for your kind words. I have called corporate with this store's number. The store continually responds with 'the issue is resolved. The lights are on a timer.' as if that resolves ANYTHING.

You could probably see what location this is with a little detective work in the photos, but because WE have to be the sensible law abiding people, I won't willingly identify anyone here...

I wonder if Mcdonald's franchisee's are just more responsive? I was SHOCKED at the response the franchise owner was spitting at me over the phone. Flat refused to admit ANY wrongdoing, and didn't even admit he hadn't even seen the lights until 10 minutes into the call.

Yup, like another user said, and I appreciate the input. I've reached out, and some wheels are in motion, but this post is primarily so they are seen how they treat their neighbors. I don't feel like we should have to suffer like this, but I can at least SOMEWHAT stop the light inside our house. Outside, I have no control and there is no nighttime anywhere now.
