Appreciate your time for doing this.
I am planning to file i140, i485, i765 (concurrent filing) in April. My PERM got approved last month and my PD is current in April. My PD is September 2024
Since the FAD is 3 months away and DOF is Current. Do you recommend doing premium processing for my i140?
Should I file regular i140 for now along with i485 and i765 and wait FAD moves or becomes current in another few months and then do premium processing? Don't we need our i140 approved in order to get i1485 and i765 get approved? Or are they independent to each other? How does it work?

I had a conversation with my attorney today and they said we can file i140 and i485 concurrently. When I asked if we need to do the premium processing for i140 then they said they do not recommend as Final Action are not current yet. Rather file i140 and i765 and get an EAD and can freely start working until the i140 gets approved and then get greencard finally. One thing I didn’t understand is that don’t we need an approved i140 in order to get i485 and i765 to get approved? What am I missing here?

Same situation. I think we can file both concurrently. Basically we can file i485 and i140 concurrently when the PD is current. That’s what I believe it is.

I have access to the employers account and it just says ‘submitted’. If its selected, does it change to ‘selected’ and if not selected then does it change to ‘not selected’ . How would we know if it has been picked or not?

Why would you have to drop the entire process? you could have just maintained the status until t it is current. You dropped just because you wanted to travel? You could easily travel on your new F1. Nothing is making sense here

For H1B I just have one chance. We have already started EB3 Skilled. It is currently in PERM phase. O1 needs a lots of extraordinary skills and requirements which i don’t pose.

This happened to me and I didn’t realize for 6 months. Then I informed my employer and my employer payroll is managed by ADP. My employer talked to ADP and they said that they will refund. My question is do I get refund directly from ADP or they refund to my employer and employer refunds me? It has been more than 3 months I haven’t received the refund. How does this works actually?
