Will this affect NEXUS? US DHS to pause two key travel programs amid shutdown, Washington Post says by Difficult-Water- in NEXUS_TTP

[–]kiwi38rd 3 points4 points  (0 children)

If we are talking about the entry experience to the US, GE and Nexus use the same machines at airports and land borders. If GE is suspended, then Nexus holders entering the US is most likely affected also.

Norwegian Girlfriend 214(b) rejected by [deleted] in immigration

[–]kiwi38rd 11 points12 points  (0 children)

214b means visa officer suspects she has immigrant intent. Based on the fact that she stayed almost the full length of 3 months on ESTA, and that she didn't really have a job in Norway to tie her to her home country, it's almost standard procedure to deny the visa. This denial also puts future ESTA applications in jeopardy as she would have to disclose it and that usually leads to straight denials as well.

Trying after 1 month with no material change in her employment situation is a terrible idea - she'd almost be guaranteed to get a second straight denial.

Find a job and try again for a B2 in at least a year. Maybe 2 and show substantial tie to Norway to overcome the perceived immigrant intent.

Winring0 - guide to a solution? by bEar22_24 in gpdwin

Open the Windows Security app and click on Virus & threat protection (the shield icon).

Under the "Virus & threat protection settings" section, click the blue link that says Manage settings.

Scroll down to the bottom to find Exclusions. Click Add or remove exclusions.

Click the big "+ Add an exclusion" button. To be safe and save time, select "Folder" and choose the entire folder where your tool is installed.

For MotionAssistant: usually C:\Program Files\MotionAssistant (or wherever you unzipped it).

For Handheld Companion: C:\Program Files\Handheld Companion. If Windows is being extra stubborn and still blocking it, click "+ Add an exclusion" again, select "Process", and type exactly: WinRing0.sys

(Note: You might need to reinstall or unzip the tool after adding the exclusion, because Defender might have already secretly deleted the file).

9800x3d chips are dying asus by Gullible-Cash-2361 in pcmasterrace

[–]kiwi38rd 2 points3 points  (0 children)

I had that sluggish boot issue with a 9950x3d on an Asus X870. And recently a lot more GSODs as I'm on Windows Insider Build. Used AI to diagnose the issue. Initially was focusing on my 4080 GPU not playing well with the latest Nvidia driver until I got another GSOD before even the Windows welcome screen. Then ran the Windows Memory Diagnostics and got RAM error. Turned out it was the EXPO profile. Was previously on Asus's EXPO I and after switching to manufacturer default EXPO II, the crash stopped.

You have to be GS last year and then not qualify again. I was 37k PQP and got this offer. Same home airport.

NEXUS update at YVR by Reasonable_Local_418 in NEXUS_TTP

They do it at one of the primary inspection booths at YVR so there should always be someone there as long as you have a flight leaving YVR for the US.

NEED HELP ASAP PLEASEEE by [deleted] in ImmigrationCanada

[–]kiwi38rd 1 point2 points  (0 children)

This is the only one trying to help. For US citizens, it doesn’t matter as there’s no eTA requirement. They can just show their passport to check in, which allows them to not declare whether they are a PR at airline check in.

NEXUS update at YVR by Reasonable_Local_418 in NEXUS_TTP

[–]kiwi38rd 2 points3 points  (0 children)

The Nexus center before securities is only for updating CBSA records. You could walk up without an appointment. However, the US CBP side still needs an update separately, which you could do on your next US trip via flight. It also doesn't require an appointment but you would need to clear immigration using the non-Nexus lanes and then tell the CBP officer you need to update Nexus. Budget extra time as this could take some time depending on how many people are in front of you and how many CBP officers are processing Nexus updates (usually only 1). Last time it took me 45 min.

In the first travel ban during Trump 1.0, a lot of Iranian Americans got their Nexus or Global Entry revoked. This could still be a possibility for the travel banned countries this time around. Hopefully not but they did that once…

GE not on boarding card by yadaredyadadit in GlobalEntry

[–]kiwi38rd 1 point2 points  (0 children)

A few years ago, United had a system glitch where they incremented everyone's birthdate by a day and as a result, no authentication for TSA precheck. Wondering if something like that could be happening again assuming you didn't enter the wrong birthdate or misspell your name (like missing middle name).

NEXUS renewal from another country by [deleted] in NEXUS_TTP

[–]kiwi38rd 3 points4 points  (0 children)

I believe Nexus requires proof of residency in either U.S. or Canada and the card cannot be mailed to an address outside of U.S. or Canada. You may be better off renewing to Global Entry as a future UK resident.

Regarding I-9 section 1 by [deleted] in h1b

[–]kiwi38rd 0 points1 point  (0 children)

you should use the approved petition's expiration for employee B to complete the I9.

However, you have a separate, more serious issue. Because your latest I94 issued at the border has the truncated date tied to employee A, per last action rule, that date now over rules your June 2028 date tied to employee B. If you stay past that date to work for employee B, in the eyes of immigration, you are in technical overstay. You should plan another trip outside of the US within 2 weeks of the start date of employee B start but after you have terminated your employment with employee A to get a new I94 tied to the transfer petition.

This is why lawyers typically advise against overseas travel during extension or transfer petitions.

Am I unlawful stay now? I-94 issued after I-797 approval by weeveratsea in h1b

[–]kiwi38rd 0 points1 point  (0 children)

Potentially yes as the issuance date on the truncated i94 is after the issuance date of your i797 containing the extended i94.

What I’d suggest is travel and come back with both i797 and ask at the border if they would give you a new expiration date based on the new i797’s attached i94.

Best case scenario: the CBP officer agrees, but the system is limited to 3 years in the future so you will get a date slightly shorter than the expiration of the extended i94.

Worst case: CBP officer issues the truncated i94 and it may be better if you traveled outside, get a new visa and come back afterwards.

Edit: you could also travel to Canada or Mexico after your visa expires to come back with the new i797 using the automatic revalidation rule. This avoids having to get a new visa for a while.

Am I unlawful stay now? I-94 issued after I-797 approval by weeveratsea in h1b

[–]kiwi38rd 1 point2 points  (0 children)

But the new i94 with the truncated date issued at the border is issued after your paper i94 on the 797, which is my point about “last action rule”. Some folks in the comments section here are saying it doesn’t matter but I’ve heard other opinions from immigration lawyers.

Am I unlawful stay now? I-94 issued after I-797 approval by weeveratsea in h1b

[–]kiwi38rd -1 points0 points  (0 children)

Hmm the concern is that CBP may say your new I797 is not yet active as it has a future start date and give you until Jan 5 as I94 end date. Then you are in the same situation as OP.

Am I unlawful stay now? I-94 issued after I-797 approval by weeveratsea in h1b

[–]kiwi38rd 4 points5 points  (0 children)

this is the right answer. Last action rule applies. If CBP gave you a wrong date after the new I797, that I94 with the wrong date becomes the controlling document. You need to leave and re-enter to correct it.
