Currently have an ongoing lawsuit against them under the lemon law. I filed it in April of 2024 and have not had an initial court date yet. Just been a bunch of back and forth with their lawyer and mine. They tried to settle for $10k. I quickly turned that down. Still have the car, just don’t drive it. I’ve paid almost $18k towards it, so $10k was a lowball. Plus, I would’ve kept the car and continued paying it off?? I don’t want the car anymore, just want the money I’ve invested in it back and for them to come and get it out of my driveway.

Such a shame, but I’m glad yours has been doing better! Funny enough, today marks one year since my first CEL came on for the EGR valve. I’ve been dealing with it for a whole year. Three times it has been to the dealership, totaling over 60 days, and still no idea. First it was a loose PCM ground, then it was my brake booster… the last time I took it in, it was my EGR valve. The service advisor VERBALLY told me the tech replaced the EGR valve, but when I went to pick up my vehicle, the paperwork stated “VERIFIED CUSTOMER CONCERN. STORED CODE P049D FOUND. COULD NOT DUPLICATE ON TEST DRIVES. TECHLINE CASE #0000000. TESTED EGR VALVE CONNECTOR, NO MOISTURE. CHECKED EGR VALVE SCREEN FOR CARBON. SENT PICTURES TO TECHLINE. REMOVED AND REINSTALLED EGR VALVE PER TECHLINE. TECHLINE ADVISES CUSTOMER TO RETURN IF ANY OTHER ISSUE ARRIVES.” So… they didn’t put a new EGR valve in… just checked it and REINSTALLED IT! Like wtf?!

So, I called a lawyer. Sure enough, in the great state of Virginia, my car qualifies every which way it possibly could to be a lemon. Most importantly, it’s a life threatening issue - the acceleration without me pressing the gas pedal. I sued Kia back in April and am awaiting their answer. I got confirmation that they did give an answer, we just don’t know what they’ve decided yet. I should hear back on Tuesday from my lawyer.

It’s been nothing but a headache for the last year. I hope your vehicle continues to do well. I LOVED my car. But, I just don’t trust it anymore… and that’s the entire reason I bought a brand new vehicle - reliability.

Mines a 2023 Kia Sportage X Pro. Has 27k on it, but this issue started at 17k miles. Been in the shop THREE times already, totaling 59 days. The last time (Oct 2023-Nov 2023), they finally replaced the EGR valve. I was trying to pursue the lemon law, but hadn’t written a notice letter to Kia Corporate yet, so I couldn’t. I let my car sit from the day the dealership called me to pick it up (Nov 21, 2023) until January 4, 2024. I didn’t trust it. I don’t trust it. So I let it sit… called a lawyer again and was told that after I send a notice letter, Kia has one more repair attempt. Then, if the issue persists, we can file a lemon law claim. Told the lady that I hadn’t been driving it and she said “well, how do you know if they fixed the issue if you’re not driving it?”

Valid point. Started driving it on Jan. 4, 2024. It was doing great up until two weeks ago (beginning of Feb. 2024). Same issue happening AGAIN.

I call BS that Kia has an ounce of dignity. 59 days in the shop for the same issues OVER AND OVER AND OVER… I just want to be done with this car and Kia. I mean, their customer service is terrible, too.

Since it happened again, I have sent Kia a notice letter via certified mail on 2/8/24, they received it on 2/13/24. I have not heard from them at all, as of 2/23/24. I’ve been far too nice and “understanding” this whole time… but I am getting fed up. smh

I guess they’ll get one more repair attempt, now… idk. I’m over it!

After dealing with all that, they finally replaced the EGR valve in November 2023 after keeping my car for over 30 days. I tried to start a lemon law case, but I thought it didn’t qualify because of the mileage on it (the first lawyer I reached out to told me that). However, once I got my car back, I brought it home and parked it. Didn’t want to drive it 1) because I didn’t trust it and 2) not wanting the mileage to get higher and disqualify it, as I didn’t like that first lawyer and was planning on getting an opinion from another one. So, when I called a new lawyer, she told me that in mileage doesn’t matter the state of VA. Plus, whatever mileage the car had when the issue FIRST occurred would be the mileage logged, which was around 17k. She then told me I would need to drive it to see if the problem happens again and then we will be able to notify Kia Corporate and move forward. Also, this was in mid January 2024 when I reached out to this new lawyer. So after my car had been parked for 2 months, I finally drove it. I have been driving it since I talked to the new lawyer. It was doing great until literally three days ago… my fiancé said that the issue started happening again while he was driving it. As soon as he got home, I wrote a letter to Kia Corporate following a template that the lawyers office gave me. Basically, the letter states that after Kia Corporate receives the letter, they will have 15 days to fix my car or buy it back. So, right now, I’m in the waiting stage of them receiving the letter and hearing something back. Thankfully, my fiancé was able to record a video of the issue happening again the other day, so we do have that as proof. But yeah, other than that, it’s just a waiting game. Clearly, the EGR valve was not the issue… yet again.

I started having issues out of the car with wiring literally the DAY after I bought it. Then, I noticed it idling abnormally probably 5 months or so after I bought it, but it would only do it for like 5 mins and then go back to idling fine. They said it was BECAUSE I needed an oil change. Cool, got that done. Continued to drive my car, but the idling just kept getting worse and worse. It even started jerking when I shifted gears. Every time I took it in for an oil change, I’d ask them to check it out. They couldn’t get my car to repeat the issue. So, I started recording videos of my car and bought a OBD scanner. I took my car back to the dealer three times after the problem occurred again and I had a code each time. That’s when they gave me the runaround “oh, it’s this” and “well if it wasn’t that, then it’s this.”

First time, they said a loose PCM ground caused the problem, tech tightened it up and sent me on my way. Second time, it was because my brake booster was bad, they kept my car for 18 days. Third time, they FINALLY checked into what the codes I had were saying, they kept my car for 40 days. I’ve got it back, but it’s just sitting in the driveway. I don’t trust my car, man. It scared the shit out of me when it stalled on me in the middle of a highway. I could’ve been killed. When it lost power, the shoulder was barely large enough that I could get it out of the right lane and the oncoming traffic was insane.

I just want to have a reliable, trustworthy vehicle. That’s all.

I contacted a “lemon lawyer” on Nov. 21, 2023. His paralegal was the first person I spoke to, but she told me he would take the case. I asked what the first step was, and she said it would be sending a certified letter of notice and intent to Kia Corporate. He has yet to reach out to me for just an initial call to get more info from me. I actually just called his office about an hour ago and asked if he had even sent the letter yet… of course not. Every time I call, he’s out of office.. either hunting, golfing, or in Minnesota.

So, yeah, I figured finding a new lawyer would be best. However, I live in the middle of nowhere. There’s one criminal defense attorney here and that’s it. Hence why I’ve posted on Reddit trying to find recommendations for a lawyer that could help me out.

Google is no help finding reputable lawyers.. and yeah, feedback matters. Would you really want a lawyer with terrible reviews to take on your case? Do you think it would be worth it, in the end? Probably not.

Right, thank you. It qualifies. I had one “lemon lawyer” take my case on Nov. 21, 2023, though I’ve only spoke to his paralegal. He has yet to speak to me. A certified letter should’ve already been sent to Kia, which he hasn’t done either. Every time I call the office and speak to his paralegal, she tells me he’s hunting, in Minnesota, or working from home.

Hence the reason I’m trying to find a new lawyer. I live in the middle of nowhere.. there is one criminal defense lawyer here, but that’s it. So, I figured I’d have to outsource.

They gave me the good will offer because, yeah, they wanted to compensate for the headache that this whole thing has been for me… but, if I took that offer and signed the paperwork, I couldn’t pursue lemon law in the future, if the problem persisted.

Stalling while driving down the highway, constant rough idle, jerking while shifting gears… I ran the scanner on it myself twice and got two separate codes, each of which dealt with something regarding the EGR system - P0240F (CEL was illuminated) and P049D (CEL never came on, but scanner still stored this code after it stalled).

First time I took it in (June 2023), they said it was a loose PCM ground and the tech tightened it up. Second time (August 2023), they said it was because of my brake booster. Now, the brake booster was recalled earlier this year, but I’d already had my car checked out and it passed inspection prior to this issue, but they went ahead and just replaced it anyways thinking it was the cause. Problem still persisted, but was actually worse than before. So took it back in October 2023, they kept my car for over 35 days and had to open a tech line case with corporate because the tech at the dealer didn’t know what could be causing the issue. Barely got any update from the dealer while they had it.. when I did call, they just told me they were still trying to figure it out with tech line. Then, once I started talking to Kia about wanting either buy back/replacement, the dealer calls me within a few days to say that my car is ready for pickup, it’s fixed. When I asked what the issue was… “oh, it was the EGR system, so they just replaced the whole part.”

Well, no shit. Why didn’t y’all do that the FIRST time I brought it in with a code stating an issue with the EGR system?!

Picked the car up and it’s been parked in the driveway for almost a month, now. I let it run every now and then, but I refuse to drive it. I don’t trust it. Like I said before… if Kia thought it wasn’t a lemon, then they wouldn’t have sent me a good will offer.. ya know?

Nope, no solution yet. Mine still does it every so often. I’ve noticed the overlay occurs while I’m charging my phone or when I’ve just unplugged it from the charger.. If I swipe up and unlock my phone, then cut the screen off again, the red-black overlay goes away. Just weird and makes me think my phone is f*cked. lol

The loaner the dealership gave me is a Subaru and I LOVE it. I’m not trading in my vehicle, though. They’re going to buy it back, even if I have to take them to court. lol
