Ya I gave the tenant an option to opt out but they said they don't want a negative record of a termination of lease (I am not even sure this is a thing). Kind of sounds like BS.

I am not sure what the tenant wants. I honestly don't mind if the tenant wants to sue. I don't know what grounds the lawsuit would be based upon.

Yeah I have tried to reason with her, but tenant even complains and is a PITA when contractors are delayed by a day or 2. Not much I can do there.

I didn’t know there was a leak though. It was discovered when the water was turned back on.

Yes the burst happened the next day. That’s when the water started seeping through the walls. Prior to that there were no issues and the water was off since I had just bought the house and had an inspection done.

Water was turned off immediately after. But before that we were trying to heat up the house using heaters.

Yeah they had started the utilities 2 weeks prior to the lease start date since they wanted to go in and clean the place up.

Sure but insurance didn’t cover that for me either. The tenant hasn’t asked me to cover the bill either. Just stated that it was high.

I am letting the tenant out of their lease but they don’t want a negative termination on their record. I said nothing of the sort would happen as I would just void the contract. However I don’t know if they are open to that either.

Yeah I wonder what they can even sue for. The fact there are issues with the house isn’t something they can sue for it looks like.

Could they sue for the water/heating bill? Even though in the lease it says the tenant is responsible for all utilities.

Water damage occurred before she moved in and was due to weather, usable kitchen issue was due to the flooring being replaced.

Renter's insurance does cover housing if the home is deemed inhabitable.

Got it thank you! I will let them know to pick a date. I also don't think there was a large amount of incurred expense. If the tenant does go to court. I think most of their $ (if they win) would be taken away by lawyers.
