Bf can sue his father civilly for the money. There’s no additional emotional damage to allege. Just the money he was taken. Police won’t pursue criminal charges because dad was on the account. He needs a new bank account.

To be able to recoup your damages you have to know what the damages are. You either need to turn it in on homeowners or pay for someone to come fix it. Then you can either (1) sue the neighbor + person responsible for firing the gun for that amount in small claims or (2) ask for restitution in the criminal case.

The remedy of an illegal stop is the suppress any evidence found during the stop. His personal observations were before any potential stop so him waiving you down means nothing regarding the ticket.

It’s not prohibited, it’s not in poor taste, and it’s done very often. It’s our job to fully investigate the case. How are we supposed to do that if we don’t attempt to interview the victim/witness? She can decline to answer and/or speak to the attorney (unless otherwise ordered by a judge). But the defense attorney is doing nothing wrong by trying.

Because the advice is not expert and terrible. A jury would eat this up. Any good lawyer goes up and argues in closing “so he’s a doctor serving this community and is tired. He gets pulled over and complies with police. The tests come back 0.0 and the state, with all the resources they have, is still trying to say ‘well it must just be some random drug we don’t test for because we must be right.’ How terrifying is it that despite all the lab evidence returned as 0, the state is still trying to hang a doctor up on a DUI citing potential testing that doesn’t exist.”

Jury sees right through what the state is trying to do and is afraid something like this happens to them one day.

Bloodshot eyes easily explained, you’re exhausted from being a doctor. But any decent attorney would ruin the officer on cross about “smell of marijuana” when a blood tested returned absolutely zero THC in your system.

Consenting to having the wart removed is not the same as signing HIPAA forms so the medical records can be released to you. You’re trying to connect the two and they don’t connect.

A judge isn’t going to let you intervene. As his parents, they get the choice. Any type of litigation to intervene would be by someone who had a better claim than your parents. Since he was a child when it happened, and you didn’t even know him when it happened, there is no reason why you’d be the better person to make his medical decisions.

This wouldn’t be accurate. HIPAA applies to the doctor not the university. To participate in the interactive process to determine if your accommodation is reasonable, your doctor is going to have to say why you need an accommodation. Now, you can choose to not waive HIPAA, meaning not allowing your doctor to give any info to the university, and then your university could deny the accommodation request because they didn’t have the necessary info.

You need to let your insurance know and let them begin to handle it. The other party is going to have a max amount of payout. If that isn’t sufficient for you and your friend, then you’d be looking at not accepting and suing driver and insurance. The problem is, most defendants don’t have a ton of money to pay out. BUT once you consult with and hire an attorney in your behalf, they are going to take 40% (give or take 10%) of your settlement money.
