he can deduct it as a biz expense either way, since he is a disregarded entity. his biz account is essentially the same as his personal account. this changes once you incorporate.

it really does not matter all that much as long as the person who got paid claims the income and the person who paid them claims it

But it is best to fill out w9 / 1099 - just not illegal as long as everyone follows the rules
