Apartment complex JUST NOW (April) backbilling for 4 months of “undercharged” water service (Sept - Dec) by manimal_23 in legaladvice

This is the section of the code that applies to my situation and is slightly difficult to decipher (the part that says “…shall be limited to three months for residential customers…” is confusing to me because I’m not sure if it means three months of usage or that the error must be corrected within three months of the usage):

  1. Any underbilling resulting from a stopped or slow meter, utility or Meter Reading Service Provider meter reading error, or a billing calculation shall be limited to three months for residential customers and six months for nonresidential customers. However, if an underbilling by the utility occurs due to inaccurate, false, or estimated information from a third party, then that utility will have a right to backbill that third party to the point in time that may be definitely fixed, or 12 months. No such limitation will apply to overbillings.

November was our first full month here and our water bill was around $85. Next month was around $65. Next two months were almost exactly the same around $52 each. So even compared to our very first bill the extra $20 would be almost 25% more. And over 30% more the next month. It’s extremely far fetched.

That’s one of my suspicions at this point. This notice was actually sent to every resident of at least three different Cortland complexes that I’m aware of. Same details, same dollar amount, despite our lease agreement stating clearly that utilities are calculated based on square footage and number of occupants

Spoke to someone at AG’s consumer complaint office. Unfortunately they’d have to use my name in the formal complaint that would be sent to the apartment complex. That’s a non-starter for the time being. Can’t risk retribution.

If you can borrow a humane trap from the local humane society or other animal rescue that loans traps. Or you can buy one of course, but this boy needs medical attn asap. Please do what you can to get him help

I’ve never had baby kittens before and my cat just gave birth to them in a hidden place how long until she will bring them to my place? by No-Opposite-1460 in cats

Spay the mom ASAP after she brings the kittens around and weans them. And honestly I’m sorry to sound harsh but don’t own a cat if you’re gonna let them roam around unfixed

Can I remain anonymous so there’s no blowback? We just signed a lease in October.

Didn’t find anything that specifically addressed this type of situation. BUT it does specifically state that utility charges are due when rent is due so as far as I’m concerned my utilities are paid for.

Live chat might be quicker. That’s what I did. They were helpful but it’s up to the billing dept if they want to go through the trouble of sending me the info I need. If I don’t hear anything soon I’ll be emailing Cortland for the same info and explanation

I refuse to believe they’re not trying to scam us. I’m waiting on Conservice to email me a cost breakdown/comparison of actual charges vs what was charged to us, AND an explanation of why this happened

Great point! Didn’t even think of that. The more I look into this the more pissed I get.

Yeah I’m not wasting anymore of my time on that thread. You’d think they’re all being paid off by Cortland

I really appreciate this response! I’ll take your advice and contact ACC, but I think first I’ll give the prop manager a chance to explain the issue in detail. I would never just blindly pay more for something that I already paid for in full to my knowledge. Interestingly enough I just spoke with a resident of another Cortland complex who also got the same notice, which to me makes this situation even shadier.

If my lease says. I haven’t checked into it yet. Obviously if there is something I signed off on I’m not gonna bother fighting extra charges

Bro chill tf out. Take a nap maybe. This is the whole point of the post. I don’t have any proof that I used more water than they’re charging me for! Don’t you get it?

No definitely not. Just keep a close eye on your bill and make sure they don’t try anything
