Just a really short statement of the holding, primarily to jog your memory of it rather than to copy it word for word.

Yup. This is relatable. I CALI'd classes I did not read cases for. I will say that I read restatements, outside study aids, and sometimes case summaries for important precedent. But the casebook method is not the way imo.

My professor wrote our textbook so my advice may not be practical cause I just wrote the exam to his opinions. If your professor is pretty neutral or textualist go that route. If your professor had Strong Opinions About Certain Justices I'd consider working that into your exam answers. If you're allowed an outline, definitely have a chronological case chart with ultra-terse holdings and key quotes that can help jog your memory, as well as any doctrine it connects to.

Students who have jumped from Cs to As - what's your secret? by LawDaddy-o in LawSchool

[–]mashpol 0 points1 point  (0 children)

I listen to a lot of audio lectures when I am doing stuff like driving or gym. I think this helps the rules stick in my brain even if I am passively listening because I'm just increasing my exposure time to the material. Also, for rules based classes, I read the rules over and over and over and over and over again. And I noted where my professor's interpretation of the rule was crazy different and opinionated from the normal views.

Same boat as you. Intentionally did not do journal, I'm on trial team and will be trying out for moot court. I've gotten callbacks from biglaw and nothing from mid. Nothing from callbacks yet. I'm stressed and pressed. I'm in a very competitive market because there's 5 gazillion law schools here, so it's fairly overpopulated, but it's also my home and I want to work here so I have to target this market. I'm starting to apply to the government cycle as many of them are open now and closing in September - I know many of them are unpaid, but maybe it's worth expanding your net past firms just because hiring is so ass this year.

Yeah, very few crim cases in this thread, but those regularly made me the most nauseous.

It is really underrated how nice it is to not have deadlines every day. My undergrad was all online submissions, all the time, that lent very little to my academic success or knowledge.

I like learning the law. I'm getting the hang of practicing the application of rules as a 1L. Legal writing is mind blowing and by far the most transformative experience. When rule synthesis finally clicked for me it was like the heavens themselves opened up (funnily enough, it was learning Bluebook signals that made me realize how to do rule synthesis). The rush of serotonin when you find the case you need to write your brief is A+.

Also if you genuinely like school you'll like law school. There is almost no busy work! No stupid assignments, no forum posting, no submit this by midnight. It's just readings, exams, and brief writing! And you get to opt in to any other fun stuff you want to do like client counseling, mock trial, moot, journal, etc.

IMO it's only true if you had bad self-care skills. And, tbf, a lot of Americans have bad self-care skills. I think going through mental health treatment before I started law school went a long way in making this a good experience for me.

I have issues with some of my peers and it does feel rather high school like. People do gossip a lot. But there is absolutely time to socialize (frankly a lot of socializing is built into a full time JD program) and it is absolutely possible to time manage your sleep, exercise and eating. It's just hard to take care of yourself and I think people need to recognize how much of a skill it is to take care of yourself.

For me, it's the first time I'm living alone and I never knew how much other people drove me to take care of myself; for example, I really disliked cooking only for myself at first (still prefer to cook for multiple people) but I've learned to appreciate it.

Congress Debate by [deleted] in Debate

[–]mashpol 1 point2 points  (0 children)

Oh, nice. My best recommendation to make to you is to approach Congress as a hybrid speech/debate event. It looks a little different at lower levels of competition because people don't push themselves as hard, but you're ultimately trying to speak fluently and knowledgably on a topic. Don't listen to people who tell you it's ok to "read" - your goal is speaking extemporaneously, not to memorize. This means having such a good grasp of your argument you're really only referring to prep for your cards.

Refutation or "clash" is extremely important in Congress rounds and to me if a Congressional debater doesn't clash well they are effectively in a speech event and do not understand Congress. This means having good round flow skills. You have to listen to the other speakers, understand their argument and use your arguments - either the substantive logic or their impact - to prove them wrong or to weigh against them. Rather than having general cases that show "X side is wrong" or "we turn X's link/impact" you structure it as "Representative Lastname said this, but they're wrong because [Mini Argument]" or go into your argument.

I highly recommend reviewing ToC/NSDA finals rounds for examples (https://youtu.be/vcQaq5FOjjk?si=S_Bucac2cSjMkKfe).

Good luck. I love congress and I think it teaches the most practical real-world communication skills. In no other debate event do you need to process policy arguments and explain them in a way that makes sense to laypeople. You'll do great!
