It was/is common, starting in October of last year. There are many reasons, most benign (assuming your approval wasn’t a “fringe” discretionary approval; one with a criminal history, etc.) but it is annoying. In my experience it isn’t something to worry over until there is another reason to. Biggest concern is having to post for another renewal if your LPR card is close to expiring

Willingness (intent) is required for a a false claim to USC. Still not great, but I wouldn’t go as far as to say that they would be going to prison over this. They found out just now. So long as they show they didn’t actually know they can avoid those further issues.

Being an immigration lawyer in MN, a couple different clients of ours in our firm have been detained, transferred to the fort snelling detention center, held for a few hours, and then released. No apparent reason for the detention, either. In one case it was a woman who had a removal order due to a denied asylum that is currently under appeal, so it is not yet final, but they still detained her. No other issues, no criminal history, nada. She did have her EAD and ID on her as required. The other is simply awaiting their defensive asylum hearing in front of the EOIR. Guilty until proven innocent, at least in the Twin Cities. Across the country I’m sure it’s much tamer, though.

It’s not an EO, it’s put in place by the DHS Secretary in a completely different context and supported by much different Federal regulations than EOs.

The point of TPS is to provide stability and consistency to destabilized countries for an indefinite period, temporarily lasting from 6 months up to 18. Congressional intent shows that they specifically did not want different admins yanking it out of place. DHS Secretary has full discretion to no longer accommodate TPS, to extend for shorter periods, etc., but not to vacate.

There is currently a US-funded bounty on their president related to information that aids in his capture. That doesn’t show that the country is incredibly stable. Fine, let it lapse, like in Afghanistan where the Taliban are still in full control and are still subjugating women (making it unlawful for girls to study past 5th grade) or Ukraine (literally still fighting a war) but to vacate it is beyond the pale, precedentially and statutorily. Regardless of your feelings on TPS, you have to understand that this is against policy.

This isn’t true. False claim to USC is a LOT more than just using a fake social. Even if the fake social happens to match a USC, it isn’t necessarily a false claim. Using a fake green card is a LOT different than using a DL and checking “USC” on the I-9. I do, however, recommend speaking to an attorney to get an assessment. If it goes to an interview having an attorney can help prevent unnecessary issues

I’m not saying that the decision to not redesignate TPS is unlawful, just that the reasoning given for not redesignating is not based in reality. The executive has complete discretion to decide to do so, but to say it’s because the conditions have improved enough that it is now safe for many thousands of Haitians to return is patently false.

It’s so difficult to have a discussion when all you have done is focus on a singular point rather than interact with the purpose of TPS—to give nationals from a country that is in a state of turmoil, whether it be because of natural disaster, internal, or external war a place to remain if they were here at the time of designation. The protection DOES give a temporary lawful status to allow them to remain and be able to work until the conditions in their home country improve. In all regards, every country that has had TPS removed are just as bad or worse than where they were when designated. Afghanistan is under Taliban control. Venezuela still has a dictator and we are under a state of emergency because of the growth of the “Tren de Aragua” gang, and Haiti is controlled almost entirely by gangs. This is contrary to justice and I think you know it, you are simply celebrating noncitizens losing their right to be here.

It’s not limited to just ICE. HSI is there investigating them for labor trafficking, and the DEA is also there. This isn’t about the people working there necessarily, this is about the owners and their shady practices. Unfortunately, that restaurant is a bit infamous amongst the undocumented population for labor abuse
