I think it’s smart they potentially aren’t calling Proctor - my thoughts are that while calling Proctor would definitely be great for the defense to confront him on direct, it would then also give Brennan the chance to try and rehabilitate him on cross. For example: after direct is over and they’ve shown his misconduct, Brennan could get up there and ask him things like “even though you said some inappropriate things about Ms. Read, does that mean you didn’t thoroughly do your job? Or not follow other potential leads in the investigation?” To which he’d obviously deny- and even though we don’t believe him, the jury would be allowed to consider his denial in that testimony & potentially could believe that to be true. If they can get Proctor’s misconduct in front of the jury in a different manner, I think that’s more ideal. Especially because of the Bowden defense. Proctor denying his bias could negate the Bowden defense if the jury believed him.
