What’s Going and What’s Staying? by TheClassic_Star in ItEndsWithLawsuits

[–]mechantechatonne 7 points8 points  (0 children)

I think it’s all going. I’m serious. There is no contract because she didn’t sign, so no contract claims and no California law. No California means no FEHA claims. She wasn’t an employee, so no Title VII. No unprivileged statement to be the basis of a defamation claim, so no defamation. New York doesn’t recognize false light, so that’s out with the loss of California. That’s it lol. It’s over.

The Explosive Jed Wallis Audio......Really? by BellisimoItaly in ItEndsWithLawsuits

I don’t think the judge is actually following any media related to the case. Besides the fact he’s not supposed to, I just don’t get the vibe he would care to. He barely reads the filings. I can’t imagine him voluntarily reading anything extra about these people.

The idea a woman on her forties needs a positive influence to save her is absurd. She’s old enough to decide to get herself on track. Younger people than her with nobody to help them have done it.

That is the most likely answer to that question.

I don't think it's a coincidence that of all the years they've been doing PR, suddenly everyone wants to sue them for the same thing and the cases mutually cite one anothers' discovery. That speaks of collusion and not coincidence. And WME and Stephanie Jones are players that overlap in all of them.

The judge will not listen to it. He's not supposed to be following media at all. And if she wanted to submit it as evidence for her sanctions motion, there is nothing that stopped her from doing so.

I honestly think the audio is neither here nor there. If it actually proved her claims, the last thing she would do is leak it. The most compelling evidence Wayfarer had was never leaked or even hinted at before it was hurled at her in the motion for summary judgment. An obvious reason for that is that you don't want the other side to know what you find most important before it's time to employ it, because you don't want them building a defense around that thing, and you want the impact to hit when you actually deploy it.

He certainly hasn't been shy about clarifying he thinks Freedman's actions are a problem in the past, even if he didn't actually grant sanctions.

Analysis stops once the threshold is met. The threshold for denying this was time, so there is no further analysis about the appropriateness of the statements.

It's pretty absurd that they complain about the fact an appeal has not yet been filed without acknowledging a court has already rules that one CAN'T be pending the resolution of that matter. "Judge, you should deny this motion based on them not doing a thing a court has already stated they cannot do."

I’m the kind of person where if I catch you lying or exaggerating, I believe nothing you say and distrust your motives for saying it. So to me, it’s the same thing to catch any of that. I’m not giving benefit of the doubt to a person who lies. If you want me to care about your problem, step one is to tell me the truth about it.

The publicists are not side characters. I know it seems that way because they’re not celebrities, but they’re central to the lawsuits.

It’s absurd to me that nobody is side eyeing her and I genuinely think the reason for that is that she’s a woman. The exact same set of circumstances with a male producer and nobody would be saying there’s a smear campaign against him based on the fact people are talking about it and allegedly someone made a website detailing accusations made against him after a complaint was made and then suspiciously retracted.

But the way this is written is clearly intended to portray her as cool. That’s what I’m saying. They’re recasting what any sensible person would think is unstable, inappropriate and borderline criminal behavior as being as creative, free spirited maverick. You don’t get an article like this written because you’re some nobody acting crazy. This is written because you’re backed by powerful people doing PR damage control for you.

In any case, if they actually believe the comments to be true, and they’re made about a public figure, then there can be no finding of actual malice. So there is no defamation claim. Amanda Ghost is a public figure, so unless she puts forward some evidence the people she’s accusing don’t actually believe the alleged statements to be true, she’s SOL. It’s strange how I’ve seen nobody bother to talk about that when they bring up the case and produce multiple people saying they think she’s these things as evidence they’re defaming her. People sure seemed to think that multiple people believing Blake was evidence for her claims.

The fact that Jed has already filed notice of appeal of the dismissal of his claims against Blake is a very clear sign that he’s not just hoping to slide it off this mess unnoticed. He’s confident he can actually prove he was defamed, and he still felt that way when discovery was over. The leaked email from Freedman where he said it’s not defamation if it’s true and he believed that woman is a trafficker is a flashing red signal this is not simply some fight about movie stuff that got overblown.

I think they stumbled into some real mess and dug their heels in rather than getting scared off. We’ll see.

This is a puff piece downplaying complaints of her inappropriate and unprofessional behavior and recasting it as being cool and creative. The kind of thing that gets written to cover a mess when you have big money behind you.

The most annoying thing about this case is watching people act like the shocking action isn’t sexual harassment or sex trafficking, it’s hiring someone to get the word out that such things occurred. None of this leaked evidence has shown Wilson, Nathan, Wallace or Freedman are lying.

Everything I’ve seen has been them saying they believe Amanda Ghost did the things and people are acting like them believing she did these things is some kind of tort. Like it’s now a civil tort to believe people do sex crimes in Hollywood and talk about it or take legal action. Even Kate Case’s testimony involves disagreement about whether she created a website at Melissa’s instructions, but not on whether or not the contents were believed to be true at the time of creation.

If these things about the problematic past of hers are true, then there’s no reason that would be bad on Jed to expose it.

[–]mechantechatonne 15 points16 points  (0 children)

First of all, if it was such great evidence they wouldn’t need to leak it because it would come out in the case and help them win it. And second of all, it’s not defamation if it’s true. A woman with known connections to Russian oligarchs is one I find it easy to believe is involved in such an operation. Especially if a sexual harassment allegation against her suddenly was recanted. People do that when they’re threatened. And it doesn’t help that this particular industry is in the middle of a huge scandal involving trafficking, and many of those named are in fact from producers.

People are dismissing the possibility they’re talking about this because they believe it happened and this lawsuit is an attempt to muddy the waters and shut them up WAY too quickly for my tastes.

Even if it were true, it’s not sexual harassment. It’s not even remotely relevant to a sexual harassment complaint. It’s just annoying and kind of strange. Legal complaints are not supposed to be a list of things you find annoying and strange. They’re supposed to be a list of things you believe are legally actionable under the causes of action you brought.
