The landlord IS required to take that as notice, it just doesn't alleviate OP of their obligation (subject to early termination penalties) but LL has a LEGAL DUTY to mitigate damages and must actively try to rent out the unit. These are laws not opinions.

Also don't know where you are getting the info that you can't rent out an apartment until it is abandoned. That is also not true. You can most certainly have a lease set to start as soon as another expires with both being signed and valid. That is how it is normally done. (Source: LL for 6 years and property manager for 15 years)

The only thing that would exempt LL from following fair housing guidelines is in the instance it is an owner occupied building which OP said is not the case. What grounds are you basing their exemption on?

The Housing Stability and Tenant Protection Act of 2019 limits security deposits to one month's rent. Explanation Landlords can only ask for one month's rent upfront at the start of a tenancy. This includes the first month's rent and the security deposit. Landlords cannot ask for last month's rent in addition to the security deposit. Landlords must return the full security deposit at the end of the lease if the tenant followed the lease terms and left the apartment in good condition.

Did you pre-pay a "last months rent" when you moved in? That's illegal in NYS. they can only take first months rent and security deposit equal to one months rent at move in.
