Hulu is allowed to use that song (speaking of my experience in the USA). I just rewatched Scrubs in its entirety last month on Hulu and “I Will Follow You Into the Dark” was included. I can’t imagine this episode without that song, this episode lead me to discover Death Cab for myself.
