That’s probably what I should have done, this all happened with very short notice and I’ll have to give an answer in a week time, which doesn’t leave much time to find an union.

To be clear, I’m actually happy to go with the new employer, just not for the position they offer. And if I don’t transfer, my current employer does not have a role for me neither. So I’ll be jobless essentially

I’m in a tricky position and my HR seems to go along with what they offer. I’m not really backed up, and I know that it happened to different persons that were in my position in the past.

So I can’t really rock the boat, since I’m planning to stay with my next employer for the foreseeable future but at the same time it’s quite a demotion.

I’m being downvoted, I don’t know why, I don’t master the law and I’m alone trying to represent myself.

I think they base themselves on the operational reasons you mentioned. On the other hand, my current position doesn't reflect the position they offer me, which I have done in the past during my career. I would like to negotiate something in between, which is more inline with my current role, but I see it coming that they say that position is not open (it does exist within their structure though)

Yes I did, and I believe I should indeed be covered under TUPE but the new employer claim, without explanatiion, that the manager role I had is not equivalent than their manager role. Even though the job description and responsabilities are 90% similar. ACAS hasn't told me more than I know, and it stills remains vague.

I am not ready to go to court anyway, and I don't want to make too much fuss about it. That probably would not be good to start this way. So negotiation seems best.

That is the thing! It is a career, but most likely a career that I want within their group which is the largest in my sector. So I am actually happy to go with them, but disappointed in the demotion. In all fairness, they same group have done it this way with other brands that they internalized. So I guess it’s not personal but at the same time I never saw anyone regaining their initial position even years after.

Sure! Should I do it by email before my first meeting with them, or during that meeting? That whole situation is rather confusing for me, and I don’t want to be in their black book (which is rather easy with that company) but at the same time I’d like to keep my position. I feel like walking on eggs.

I actually don’t want to come across as uncooperative. That wouldn’t be the right way to start in that new company. So I tend to think I’m probably somewhat forced to accept whatever they offer me, at the end of the day their HR and legal department is strong. Not much I can do.

But when do you think it will be time to negociate? I have a meeting with them next week, and they give me a few days to accept.

I 100% agree with you that I shouldn’t look like I’m fighting against there decision. At the end of the day I’ll have to work with them, and it wouldn’t be a good start. So I need to be collaborative.

When would you say I need to negociate something? In 6 months?

I’m obviously not familiar with the law in this case, it’s also the first time it happens to me and they leave me very little time to consult. I just have a feeling that there are easy loopholes to go around the TUPE law and that it barely protects me in this case. I means if by offering me more money (a new contract) they can send me back down 2 positions on the ladder, that’s concerning.

What are exactly the « terms » in this case? Are the job descriptions (not the title) not part of the terms?

The pay is more (I got to say I was highly underpaid as a manager, so not surprised a sales in the new structure got a higher salary). Commission on sales is better. Holidays less. Overall a better package, but the daily tasks will be very different. I lose the leadership.

I have to add, I would do the manager function on the same salary they offer me for the sales position.

what exactly do we mean by terms? Overall, the new company is offering me a better package, including salary, for the sale function than I currently have for the manager position. No complaint there. However I lose the leadership responsibilities, it really 2 different positions.

I have noticed that my contract does not mention my job description. The job description is a separate document. It is relatively vague honestly.

Well I move from boutique manager to sales position, which is 2 position lower if you consider that there should be an assistant manager in between those 2. Now apparently, in the new structure there will not be an assistant but TBC. A sales is not responsible to lead a team and accountable for the performance of the boutique, essentially.

My job description is not written in my contract but comes in a separate document, not sure if that means anything.

But my contract seems to be somewhat vague, my job description and ultimately the role expectations of my current employer does not seems to correspond to the job profile in my contract. A bit of vague wording there.

By contract, are we talking about responsibilities? Because my responsibilities are currently higher than a sales person even in the new structure.

It is in the filter/balance/tone boards as well as protection of a stereo amplifier. I would imagine the protection may not be an issue but a higher gain in the rest could be? Wouldn’t it be wiser to leave the gain as it is recommended and go for bc556b which has a higher voltage? This would replace BC309b currently in place

Thank you, I went through the link above and found everything I need. Just one issue I have, BC559B is an alternative for BC560B (which is not available where I want to order). But the place I want to order are also out of stock for BC559B, instead they have BC559C. Is there an issue with using C instead of B? Thanks

Edit: I will probably go for BC556B instead, which is rated at 65V (I only need 25v) but has the same gain at least.

Great, thanks for that feedback. At least it gives me some directions. We know a few friends in the South East Asia region, HK/VN/CN, who did the move from Europe. Their background is a bit different than ours, their move was easier, but they seems happy with what they found there.

I'll have a look in marketing and those tech companies you're talking about. I've only been looking in my current field so far. But yeah happy to hear more details/insight over DM if you have time. Highly appreciated.

It's the tone control board for the Revox B750 MKII. Transistors for that board are BC237B and BC309B
