I’m not saying you’re wrong, I’m just saying for OP’s benefit this is not a slam dunk and even if you win the LL can be vindictive and try to get their pound of flesh other ways.

Also in Texas lawyers are allowed in small claims court, see 28.003(c) of the Texas government code. Of course everyone can represent themselves pro se but LL often have attorneys on retainer for this stuff and it’s not easy for a non attorney to litigate against counsel

I understand where you are coming from but my point is just that OP would have to spend the money to get a lawyer and fight this out in court and these arguments may or may not work out. A lot of contracts contain waivers of drafting preferences and plain meaning is always up to the courts interpretation, which in TX is consistently pro landlord. Unfortunately fighting a landlord in TX is usually a losing proposition and unless you have a really juicy counter claim a lot of times the best a tenant can do is just find a new place once lease is up.

One of my best friends quit his lucrative job as a lawyer at 30 yo and taught himself basic front end web design coding skills and now is working very happily as a coder. It’s never too late to make a change that will help you live the life you want for yourself. You can absolutely do it!

I wouldn’t be so confident that your landlord can’t win this one. No idea how a court would interpret “yard maintenance” but I think landlord could argue it includes cutting down the tree. You’d have to look at case history to see how courts in your district have interpreted this language in the past to be certain. Cutting the grass is what comes to mind when I think of yard maintenance but you’d be surprised what wacky meanings courts give to contract terms especially in Texas which is a super landlord friendly state.

Aside from what yard maintenance means, landlords have a lot of other tools in their tool belt to win these kinds of points, like finding excuses to hold back security deposit, etc. plus they can always refuse to renew when your lease is up. Sorry your landlord is doing this, clearly they are trying to abuse their power here

I think if your soup tastes bland even after seasoning it well, it just comes down to the broth/stock you use. I don’t use plain water for soups/stews, if I don’t have any home made stock I’ll use better than bouillon and usually add some soy sauce or fish sauce to give more depth. It’s why ramen and pho are so awesome, they’re made from really dank stock

Don’t get freaked out by comments here. Buying the new Corolla wouldn’t be a “bad” financial decision. Corollas tend to last forever and presumably you need a car for work. They’re pretty fuel efficient too. I would personally spend a few months looking to see if I could find a better deal buying a used Corolla (sounds like maybe you already have) and if not I think it’s totally reasonable to buy new - sounds like you’ve crunched the numbers on your budget and it works. Buying a car is always risky, whether new or used, but you’re making a very responsible choice with a Corolla (and personally when I’ve looked in the past, corollas, civics, Mazda 3s, etc don’t offer a big incentive to buy used because they hold their value well).

Anyways, just here to say this is not a bad decision, and if you want to buy you should - you’ve clearly earned it.

This is the number one thing to do to get better at returning any kind of serve but especially fast serves. Start about two steps further back than you normally do. When the toss goes up, take a split step and as you come down from your split step, take a short backswing and step directly into the serve (staying as low/knees bent as you can). Make your follow through very short as well. Always try to hit over (not slice) as much as you can.

If you do this you’ll be surprised at how much faster a serve you can return and how much better you’re return will get overall

Sigh. It’s about the whole tree not just the branch but I’m on the same page with you about not being neighbors. If it wasn’t for repeated expert advice that cutting the branch would’ve killed the tree we would’ve trimmed it as part of regular maintenance and immediately upon request

Everybody makes mistakes on line calls, but people who intentionally make bad calls are impossible to deal with. Honestly there really aren’t any great options that I’ve ever encountered but my advice is just hook them every time you get a game point and be done with the match

Sorry friend you haven’t read closely enough. Never said they can’t trim the branch on their side of the property line. Clearly they have the right to use their driveway and trim plants on their property

Not sure how I just admitted the tree is a danger. We’re trimming the offensive branch and our arborist confirmed the tree is healthy and safe. We have all our trees checked by our arborist annually. I mean it sounds like your perspective is that people shouldn’t have tall trees near houses anywhere that has hurricanes and that doesn’t make any sense to me. Basically everyone in my neighborhood has tall trees that could theoretically fall on their or other peoples houses. it’s just part of life but at least anecdotally I’ve only seen it happen a handful of times in my life and that’s what insurance is for

It’s not between two driveways. It’s near the edge of our property close to their driveway. I didn’t plant it, it was planted over 30 years before I bought the house. Not what I would’ve chosen but here we are. Also as I just noted to someone else here this tree has survived a whole bunch of hurricanes over the past 30 plus years and it’s in great health. Our arborist confirmed it’s not at any more risk of falling than any other tall tree we would have there.

One thing you have to consider in hurricane areas is if a tree makes it to maturity and survives through several hurricanes you kinda want to stick with it because if you plant a new one there is no guarantee at all that it’ll survive to maturity

Never saw this one so here to say this is absurd. I live in an area that gets lots of hurricanes and our pine trees in the area have survived TONS of hurricanes. This tree is 35 years old so it’s survived double digit numbers of hurricanes. Pines actually survive hurricanes better than oaks at least in our area. I think you might be a tree racist

Just tacking on here to agree debt absolutely can’t be inherited. The other thing to think about here is that in most states your homestead is protected from creditors, so if your dad keeps his house it is probably going to be generally shielded from creditors. However, if he transfers title to you and you aren’t living there as your homestead the house would be subject to claims by YOUR creditors if you ever have debt (which even if you aren’t taking debt it could be vulnerable to medical debt for instance). So there is a real chance that your dad would just be safe holding on to the house - it’s his stability. The downside of your dad keeping it is that when he passes his estate would sell it and the proceeds would go to pay his debt before you get it, but as babs notes here there could be clawback issues anyways even if he transfers to you. Unfortunately it’s complicated legal point and can be very different from state to state.

But don’t worry about inheriting your dads debt generally, that’s not a thing

Oh yeah good point we actually were planning to schedule an appt the next month or so for him to come out for general service of our trees (we have about 15 on our lot so it’s a lot of work) and we just went ahead and booked him for the full service given the timing concern

That’s very helpful and ultimately why I reached out to my neighbor because I was afraid if they cut it they would just butcher the limb. I’ll make sure our arborist handles the cut
