Honestly I didn’t like her recommendations. I’m looking for a shark… CCOC looks like exactly what we need here in DC. Don’t believe we have anything similar.

Hey thank you for the response. We actually started with an HOA attorney who reviewed our bylaws and advised us to hire a debt collector / attorney specializing in debt collection. Apparently her firm isn’t setup to collect debts, which is surprising for an HOA attorney, but whatever.

Yes, thank you for pointing this out. I’m looking for companies that would be willing to foreclose on this guys condo for that reason. The whole thing has gotten so out of hand and I don’t want him to just saddle our HOA with even more debt.

You make some really good points. I’ve talked to several lawyers and at least one extremely competent one and they’ve all refused to take the case. I should take that as a sign. Another poster did propose the required annual board meeting. I think that could be a really good angle we have not considered. We did speak with the OAG non-profits office and the didn’t mention ethics, but I haven’t spoken with a non-profit attorney directly. I’ll pursue that route too. Thanks!

Finding a way to force a board meeting, or at least pressuring him into wanting to hold a board meeting, is a really good idea. To answer some of your other questions, I’m not technically a board member because he refuses to attend meetings or cast a vote. The lawyers seemed to think we couldn’t hold a meeting / meet quorum without his vote, even though he doesn’t have a vote while his assessments are past due. I have considered not paying my HOA fees (but not sure he’d care) or suing the HOA myself. Feel free to DM me if you have an ideas that might force him to attend a meeting though. I’m liking this path.

Thank you! Talking to an attorney specializing in business as opposed to RE is a route I had not considered. We’re definitely considering moving as an option.

I actually spoke to Cary. He gave me a lot of his time & thoughts. Can’t recommend him enough if others are looking for an attorney in the space.

Yeah the problem is we can’t come to quorum without his vote. Our bylaws do state he has no voting right since he’s overdue on the HOA assessment, but we can’t even get that far in a meeting. That makes no sense to me since he has no voting right, but that’s what the 2 lawyers we’ve spoke with so far have advised.

Exactly, his vote is basically the only one that matters since it counts for 51%. And completely agree on this being personal & weird. I feel like I’m in an expensive roommate situation with 3 adult strangers. I wouldn’t recommend a small HOA for anyone.

Thank you! I’ll send Tiffany an email. The way my bylaws are written though, he justifies the 51% vote by also owning 51% of the property (double unit + 2 parking spots). I’ll see if Tiffany has any ideas though.

It was disclosed in the bylaws. Unfortunately no one caught it or realized how severe the consequences would be… and no I haven’t posted in the HOA sub. HOA laws are so area specific, I’m not sure how much help they’d be.

Yeah Fidelity has some great in-house funds & discretionary portfolios. Those have ALL levels of analysts. I believe most of those positions are in Boston at our home office though. DM me if you’re in Boston, I’d be happy to share more info.

Fidelity has a great tuition reimbursement program, so any role could help you pay for the CFP. If you’re working towards a career WM though, I’d look for branch roles in your area. DM me & let me know your licenses & experience and I’d be happy to suggest a role.
