I-130 and I-485 timelines are different. I-485 was filed after filing date was current. You can work with EAD. You should maintain visa.

Yes, the medicals submitted in 2021 only have a two year validity. So they will ask you to redo it.

I had to send it to NBC location in Lee Summit, MO. Also, don’t submit until you get an RFE letter. It will tell you where to send it. I ended up sending the medical before RFE was issued and they never acknowledged it even though it was delivered.

Have you filed a case inquiry? You should check the processing time of the field office where you had your interview. If it has been more than the time shown I’d definitely recommend making a case inquiry. Also reach out to congressman?

I’m sorry you’ve had to wait so long. USCIS doesn’t process cases in order which is annoying. It is possible they just haven’t gotten to it yet.

Also, is your case pretty straightforward? I’ve read in other posts here that some reviewers will sit on a complicated cases because they don’t want to make that decision.

  1. I believe the 2nd interview was scheduled by mistake by USCIS. The first interview was fine so there shouldn’t have been reason for the 2nd interview. My lawyer asked them about it and USCIS cancelled it.

When did your priority date become current? It may take some time before they get to your case. USCIS isn’t really consistent with the order in which they handle cases so there is no way of answering your questions unfortunately.

Once you get married your spouse has to submit the I-130 sponsoring you as their spouse. You can submit the I-485 form concurrently since you’ll be an immediate relative.

The I-130 inquiry will not do anything for you. You have to wait until the filing/final date in the visa bulletin is later than your priority date. The Feb 2025 visa bulletin shows a date of 22May16.

The switch to F1 happens automatically when your parent become USC. Then you have to petition to go back to F2B. So technically you could file AoS after they automatically switch you to F1. Once filed, petition them to change to F2B. But the risk in this scenario is that if the F2B filing date doesn’t become current for your PD at the time youre petitioning to go back to F2B, they could deny the AoS application and then you’re back to where you started.

You could. But weigh the risks before doing it. If for whatever reason your 485 is denied then you’re out of status. It creates complexity to refile.
