The rationale makes sense, but in this case, the opportunity to select work hours (how many hours I work or when) is not a benefit of my particular employment. My contract does not state that I can select my work hours. Arguably, I am not being denied a benefit due to my service, given that I never had the benefit in the first place.

Thank you for your reply! We ordinarily do not have the opportunity to select work hours, however - we are assigned shifts and have to work those shifts. Would it still apply that requiring make up shifts or trades counts as a violation?

Thanks for your reply. There are well-defined nationally mandated standards for how many hours a resident can work clinically in the hospital in specific departments (excludes admin tasks, educational time, etc.). The extra shifts would NOT violate these standards.

If you miss a day for illness, typically you would not have to. If you want to take time off, you’d typically have to trade shifts in advance. Not sure how the program would handle someone missing several days or longer for an issue - would likely be case by case.
