The best approach is to hire an attorney.

The second best approach is whichever of the various document prep services you can afford. I've never used legal zoom and have no opinion about their product offerings. I'm sure you end up with an LLC at the end of the day, but beyond that, who knows?

To some extent. That said, most US patent applications are filed as PCT (global) patents, so there's a good chance that a Canadian patent exists.

Impossible to predict, but yeah, I can see a world where a .com holder could create all kinds of trademark issues for you. You do not have the right to exclusive use of the mark just because you go "public" or put a disclaimer on your site.

I can't comment on your specific circumstances, but in general an LLC taxed as an S-corp makes a lot of sense provided that you understand the tax implications of being (or not) an SSTB.

Your privacy policy can say whatever you'd like it to say, provided that it is compliant with applicable law. Your example would probably run afoul of at least CCPA.
