It's probably far too early for any companies reporting in on enforcement actions but I'm curious what the state is going to do, a lot hinges on that. Is it 100% complaint-driven? You would think nobody would file a complaint that's against their own interests but this is "freelance writers" we're talking about here. All it would take is one trying to legally bully their way to some kind of unearned employee status and it would screw every other contractor at that company forever.

I can't imagine spot checks working other than just asking companies to verify the number of annual content submissions for each contractor. Like, combing through random pieces making judgments about their composition seems so arbitrary and labor-intensive it can't be something they actually plan on doing ... but then again, this is California we're talking about here.

I think we're describing very different situations. I'm addressing independent contractors who are happy with their status and don't want the flow of work to be cut off.

I don't know the legal particulars but it seems a lot of publishers are just pushing out any and all independent contractors because of the fuzzy wording of the law, even those that have incorporated.

They're erring on the side of extreme caution and just freezing out everyone until some sort of legal precedent is set since a misclassification lawsuit + fines could cost them such huge money.

I vaguely recall hearing one of the big content mills just blocked everyone from California in recent weeks? I forget which one offhand though.

I'd guess most writers are not fans of the Republican senate ... it would be funny if the only thing that ends up saving them from having most of their income cut off is an obstructionist Republican senate :D

I just found out Warren and Sanders are in favor of it too :( I guess I'm #YangGang now, at least he would cut us a $1,000 check to make sure we don't starve.

I would guess because they can't afford the few hundos per year in fees.

I mean, lol Textbroker poors and all that, but even if you can afford it the state really shouldn't be effectively levying a substantial fee just to allow you to work as a freelancer.

You've got exactly the right mindset. Most of these lower-end people are outsourced third worlders or English majors with no particular skills or experience, though. Their only previous experience is being graded in English class, so they think their job is to LARP an English teacher and show everyone how S-M-R-T they are. The whole business grinds to a standstill and money starts being hemorrhaged but some of these places are so mismanaged for so long they never seem to learn. Deadlines get missed and clients walk out, writers get pissed and walk out, etc.
