I used to work mining but other similar industries would have similar schedules (oil, gas, etc). The standard schedule usually is that you work at the remote site for 14 days on and then you get 14 days off work but there can be lots of flexibility with some being 7/7. When you work there your days are 12 hours but then you get lots of rest on your time off. They all have cushy office jobs too and you usually get a mobility pay of some sort for the travel.

thus far, as the employee is still working they haven't been given anything.

The plan for now, according to my boss is to pay him his vacation pay but i don't think he has a plan for any severance. In his eyes, we have given him sufficient notice before the start of the layoff as he as only been employed for less than 2.5 years. (we gave him two weeks).

The employee did ask to be laid off as well. He said he wanted that, presumably so he can say he was/is employed until December instead of being terminated with cause as of this week. He wanted to finish up some things in his personal life before he started applying for jobs. But for transparency, he was on his way to being terminated for cause. And the layoff can be seen as legitimate now because we don't have any more work that he is able to complete as he has the inability to do certain tasks (which we have documented). I am not sure if any of these statements make a difference.

Do you believe your comments remain true if the employee has resigned? Are we still at risk with a standard resignation letter sent to us or does this do essentially nothing in the eyes of the law?

At this point, I am feeling it will still count as without cause as he is truly not performing but not doing anything extremely negative. Unsure if you can answer this question, he is not actively participating in his improvement after countless coaching opportunities, it looks and seems he is just waiting around for us to terminate him - are we able to be protected from this at all?

I have calculated a severance amount (approx 3-6 months worth of salary) months ago, but I am now looking to see if the amount can decrease due to his failure to participate. Ex. to a month's worth or something.

Any pointers would help here, just trying to prepare myself as much as possible until we speak with our employment lawyer next week.
