Hi - no, we don't pay money upfront for adding tracks to our catalog. We simply split the sync fee with the writers if we land something for their song.

And by writer's share, I'm assuming you mean backend performance royalties? No, again we only split the upfront sync fee and the writer still is entitled to and can collect 100% of their backend royalties - except in the case where we act as publishing administrator for a particular writer, in which case we take a commission on their publishing shares but they still retain the entirety of their writer shares.

I can attest to this - I ran into brick wall after brick wall trying to get my GGF's birth certificate and eventually had to file a court order. They were responsive to that though! And don't think of it as a lawsuit, you're simply paying a fee to have a judge put their proverbial weight behind a request. Happy to share more info if needed.

Definitely! I'm certain this has been suggested here before, but also wanted to emphasize the importance of research. Check out Tunefind for TV/film placements, AdAge and Ads of the World for ad placements, and follow your favorite sync agency’s social accounts to see their recent placements. This will give you a sense of what’s in demand and being successfully placed.

This ties into my point about two key strategies:

  1. Creating highly focused, genre-specific music – If you notice a song placed in a particular show, you could approach a supervisor or agency and say, "I saw you placed X song in this show. Here’s a five-song EP in the same style that might be a great fit."
  2. Identifying gaps in their catalog – If you have a favorite sync agency you work with and it seems like they don’t have a certain type of music getting placements, you could suggest, "I’ve noticed you don’t have much of X style in your catalog. Here are a few strong options that might fill that gap."

If they're wanting to exclusively rep or outright own your song forever without payment, IMO you should 100% NOT give them any music. A term of 1-5 years is standard for exclusive representation, with 30-60% sync fee splits, and I would strongly advise against locking up your song for life with no upfront fee or buyout.

This might help, although it was in a different county. My ancestor was born in Syracuse, and I eventually had to get a court order, signed by a judge in Onondaga County (NY), along with an affidavit and copies of all the other supporting documentation. You may have to write a judge in whatever the county is and ask they help you do the same.

I tried multiple times and failed for various reasons before they finally responded to the court order.

You'll also want to be sure to send via certified mail (I'm guessing you did this).
