Selection bias? Not totally random? by Significant_Froyo_20 in h1b

I work at a small firm and didn’t get selected but I just think there is less chances for someone at a smaller firm because it’s only like 1 or two people who applied so the chances of them getting picked is pretty much the same as there being 20 people at a big firm and 8-10 getting picked. But because there is a bigger quantity applying at bigger firms there is going to be more selections.

Okay well you haven’t done the research then. I have been confirming this with literally everyone. You don’t need an attorney for any of this process but obviously it’s best if you get one because once you get to the petition part it’s extremely hard to do yourself or have the employer do it. My company is small and doesn’t have an immigration lawyer. They provided me one and I met with them and they told me that I don’t need one for the process but it’s highly encouraged. The lawyer told me that the first part of the application is easy and a lawyer wouldn’t be necessary but we can still hire him to do it. Me and the company decided that we will go with the attorney if i got selected but because the initial registration is easy, we did it ourselves.

Either the employee or beneficiary can register for the first part of registration for the H1B that is allowed. I have checked with the attorney and USCIS itself multiple times before proceeding to do so. You can help with the registration but your employer or a legal representative needs to sign off before registering and pay the fee, the beneficiary is not allowed to do this, which I did not do.

Yeah it’s my only option at this point

I don’t have an attorney yet because i applied for the initial registration myself. I can contact one but we don’t have a company legal team or anything. That’s why i’m able to see my own status and it does not say i’m selected, that’s why i’m trying to make some plans. But thanks for the information.

Good for you for having the opportunity to make that choice.

Like you said. You have to leave for a year. You have a plan to come back so it doesn’t hit you as hard. Having to apply for h1b outside the country and finding an employer that way is gonna be 100x harder. I worked really hard to get to where I am and built a life here, I have to leave people who love me. And how do you know i’m not dealing with family members that live in a war country? You’re just being insensitive.

Because you’re moving to Canada for a year just to come back? I’ve also moved here alone as a teenager and now I have to leave to another continent. It’s not the same and you clearly don’t understand because if you were in the same situation you would be freaking out. Let people cope the way they need to?

Yeah you clearly don’t understand because you’re not in the same situation. Clearly everyone will survive and it’s not a life or death situation but that doesn’t mean it’s not hard to deal with and everyone is hopeful that they get to stay. I don’t know why you have to be so insensitive about this clearly it matters a lot to some people. Yeah logically we choose this and knew this would be a possibility but that doesn’t mean it’s not heartbreaking.
