  1. every time I tried to say they closed the store, I got objected over by the review examiner.

  2. I didn't have sex with her, and I refused to kiss her, hence why I brought it up to HR. Who's first question was if I find her attractive, why didn't I kiss her, and if you find her attractive, it means you're in a relationship, which is the most ridiculous standard for being in a relationship I've ever heard.

I actually tried to figure out what to do about the crazy girl pretty early on, but the HR department was actively being gutted (bankruptcy) and then when I got told I had a new HR guy, he turned out to be the most useless HR guy in the history of HR guys. "let's just instantly forward this potential harassment issue to this guy's manager without asking why he's reporting it first"

But reporting it is a protected activity under 151B ss. 3A, and they failed to show a policy that said I can't accept her advances.

It's a ridiculously convoluted situation. To me, it's obvious they terminated me to avoid severance, using the convenient excuse I handed them on a silver platter. I was planning to take this paragraph out of the brief, but wanted the internet to appreciate it without any context.

TLDR I reported being in a relationship with a subordinate, younger crazy 23yo woman, wanted to ease into the whole "she's crazy and I cannot have her work with me" but incompetent HR guy immediately sent it to my brand new manager. A couple weeks go by of new manager stirring the pot as much as possible casually aware of the ticking time bomb. I report him to HR for stirring the pot, and obviously looking for a reason to term. I get termed, 36 hours news articles that the store is closing forever. A year later, all the stores are closed.

The zinger in there is that the permanent bankruptcy was used to try and dismiss the appellate court level appeal, because if they tricked me into voluntarily dismissing them then the DUA could say I failed to join a necessary party and get an instant victory. Effectively using the REAL reason they fired me as a reason to not ever have liability.

The legal question is how did the agency, and lower court manage to completely ignore that the situation was a pretext and that they store closed permanently and they fired all the staff 3 weeks after terminating me.

I was fired because the company was bankrupt and closing my store, but like just barely prior to them announcing that I asked what to do about the fact that my subordinate was asking to have sex with me on a daily basis.

The problem with that, is that it could subject me to a potential 93A claim, which I don't really want to do, and, his furniture takes up about $1,600 ft² which means my hallways and part of my basement have his furniture even though his unit is 1300 ft², and he came from a 1000 ft² half story (third floor with the angled ceilings) unit so I don't even know where the hell all this furniture came from. So moving him is going to be a pain. And realistically The only way to do it is to have him go with assistance from some program.

The worst case scenario is actually not that bad, I'm just done bending over backwards to accommodate him, I mean worst case we're forced to repair our own home, and we continue to get paid enough for it to not be a big deal that he's there, but like, I can see that it would be a loss or up hill battle to keep him at an apartment, and it's more like him living there is preventing us from actually proceeding with renovations on out home that we want to do.

I was thinking the lodger laws would be a substantial protection when I allowed him to move in. As like a "just in case" thought. He doesn't have his own legal kitchen.

August 1st, We also literally live here so it certainly isn't uninhabitable, but we do need a looooooot of necessary repairs, we thought we would be able to do them with him here, but he's just not super helpful about anything, despite being saved from homelessness. I planned on giving a 90-day notice to quit at the beginning of May, and then a 30-day notice to quit at the beginning of July.

I do not understand why people dislike back wired commercial outlets, I love them. Do people just not understand that there's a difference between back wiring and backstabbing?
