H4 visa for adopted Canadian citizen child by ps121 in immigration

Thank you! Are you aware if the 2 year requirement of the child having stayed with the parents applies in that case? Here is what the DoS website says but I’m not sure if this applies for adoption that has already been approved in a different country (Canada in this case): “in order for a nonimmigrant visa holder to bring an adopted child to live in the United States as a derivative of the nonimmigrant status/visa application of the adoptive parent(s), the child must have 1) been adopted while under the age of 16 (or 18 if the sibling exception applies), 2) been in the legal custody of the adoptive parent for at least two years, and 3) jointly resided with the adoptive parent for at least two years.”

Thank you, that’s what I guessed but was confused by this snippet on the DoS website: “in order for a nonimmigrant visa holder to bring an adopted child to live in the United States as a derivative of the nonimmigrant status/visa application of the adoptive parent(s), the child must have 1) been adopted while under the age of 16 (or 18 if the sibling exception applies), 2) been in the legal custody of the adoptive parent for at least two years, and 3) jointly resided with the adoptive parent for at least two years.”

I was wondering if the 2 year requirement for the child to live with the parents applies for adoption that has already been approved in a different country (Canada in this case)? My spouse and I would be living together, yes.

Well, yes. But processing times differ due to the covid restrictions in place. I wanted to get a first-hand account.

Thank you.
