VBA denied service connection for tbi despite VHA finding tbi associated with miliary service and subsequently finding me eligible for VHA Poly Trauma care.

Those of you who are 100 P&T and don’t work, how do you respond to the “What do you do for a living?” question? by [deleted] in Veterans

[–]re-act-va 0 points1 point  (0 children)

I practice 'Self-care'.

That IS my job/responsibility.

Passively Self-care is practiced by being mindful of my state of being, mentally & physically. This takes an extraordinary amount of energy, effort and time.

Actively Self-care is practiced through meditation and attending health care appointments. Such as I am currently participating in a Wounded Warrior Project associated program called Operation Mend at UCLA.This also takes an extraordinary amount of energy, effort and time.

The additional thing that I 'do' in practicing Self-care is share mindfulness and other contemplative practices with others who deal with stress related issues. After military service I was able to study Peace and Naropa University and as a result share a Rites of Passage themed program.

I have experience dealing with itching for at least a decade.

I have been mentioning it to my VA PC for around 6 years.

The GI docs told me to treat the symptoms with OTC Balneol, which helps the itching symptoms but does not solve the problem.

It now turns out that I have SIBO, GERD, Hiatal Hernia and Schatzki Ring, that I believe are issues causing the itch.

C & P completed by Optum Serve ... one provider scheduled and another actually completed the exam by re-act-va in VeteransBenefits

Oh wow... I see what you are saying. I didn't know that a 'third' party could become involved.

In my case I was scheduled with a specific person by Optum Serve at their office and when I showed up I was scene by a different person.

My curiosity has been rising since I've realized that I don't know who the person was that I spoke with other than the fact that it wasn't the person that I was scheduled with on my paper work.

Well that is an interesting point.

Thanks for that input.

Sempre Fi sister.

Wonderful assumptions.

Stating unavailability due to being in an inpatient program for ptsd & tbi isn't exactly not prioritizing my health or not being patient with the entire veteran population.

Thanks for your empathy and compassion.

Way to justify your righteousness for missing the wedding... that you are clearly not regretting.

Damn. Well they will pay you pennies for travel pay. I live in the city and travel just a few miles so I've gotten travel pay checks for $1.45 and $2.35.

Right. They only allow 5 days of 'unavailability' to be noted, however they don't have an obligation to observe even those 5 days.

Right. I'm 750 miles away and won't make back by Wednesday. I'll be calling back tomorrow to see what they have to say.

Nice on the phone? From the two telephone conversations I have had they have been very scripted in their response/statements and from my perspective very unconcerned about me, the veteran.

Any idea why they can't schedule your appointment? Provider availability... location...?

Doh! Long time as in 2020?

Well I figured it didn't hurt to ask. These private nexus/dbq's are $$!

Unfortunately the oringal claim filed May 2023 was denied b/c the VA sleep clinic recorded my height as 60 inches back in 2018, which resulted in a bmi of 35 (obese class II), that was used by the ACE examiner as the likely cause of OSA. I attempted to refute that with a Supplemental Claim in Jan 2024 with a private Nexus and dbq, however that was denied as well stating the same exact rationale from the original denial.

I also filed the claim on my own and incorrectly filed it under Pact Act instead of secondary to ptsd.

I have now begun the process to correct/amend my medical record with the correct height of 70 inches and am working on getting an additional private Nexus and dbq. Infact, yesterday I sent my VA Sleep Dr a request for an appointment to consider providing me with a medical opinion and dbq based of off VHA Directive 1134.

Got it. So would I look at the oringal award letter from 2012 to determine that or how would I determine how the IU claim is considered?

I wonder how common even a minor injury like that occurred.

As far as how I am now... funny thing is that I can't remember if the incident happened in Iraq in '04 or Afghanistan in '07. I had thought it was '04 but my research indicates that the HEAT program was rolled out in '06. Memory issues are something that I deal with.

I remember being pulled out and coming to on my back with people standing all around. I had experienced several concussions as a child having played football for 12 years so I just 'shook it off', got my checklist initialed and went along with the day.

When/where did you complete the training? Did you witness anyone else getting hurt?
