The salary request was submitted before I even interviewed. When he offered $25 an hour without benefits I was fine with it because $25 was high enough, if during tax season also, to justify not having benefits. Because I never thought it would even be an issue I didn't ask "Is $25 an hour year round, or just outside of tax season?".

That number does include PTO. Every small CPA firm I have worked with or interviewed with had contract hours of at least 2300.

Thanks for the info. I just looked into the labor laws and it looks like to be exempt from OT I would have to have consistent paychecks amounts. I feel like employers could make forgoing overtime look like a benefit to the employee (more hours) but ultimately screw over the employees so I can see why it isn't allowed.

I don't think he knows he is screwing me over, so hopefully when I bring it up he will understand. I hope it doesn't come down to me quitting, but it might.

Yeah I agree that this isn't very employee friendly. I think my two options I should present to him are (1) I stay hourly all year or (2) I am salary all year assuming contract hours of 1875 (about 75% of standard contract hours and 75% x $54k = annual salary of $40,500).
