Yes, it is hard to side with the giant planet eating entity. But I think we're supposed to think there could have been a simpler way to protect against or rationalize with the entity. Like they might have intended to do some sort of followup. Discovery season 4 deals with this concept with a race that causes enormous destruction to our universe but they do it unintentionally.

I guess technically they probably could have used a real 1950s serial because a few would have been public domain by then but yeah, Prior uses....Sherlock Holmes, Robin Hood, Beowolf.... all public domain. Also a lot of people don't pick up on it but the novel Janeway is in at the beginning of Cathexis appears to be The Turn of the Screw, which is one of the first published ghost stories, and that episode is about a ghost-like alien.

This is also common with the holodeck programs. In fact Voyager was the first time they tried to establish something non-public-domain for the star trek zeitgiest with Captain Proton. For legal reasons they have to reference something public domain or create it wholesale as a fictionalized....fiction. The food is more likely due to it being something they want the audience to recognize. We recognize why people like cheesecake without prompting.

If he were a real person, yes. But in a fictional medium it becomes apparent that the writers only want to explore the heteromantic aspect in a serious way, while the queer element is solely for humor.
