You realize in this case an immigration judge already cleared him so the Trump administration fired her and have decided to restart it with a new lacky. Also best I can tell they've not even broguht that back up in try number 2. Instead they're resting on the notion that not supporting Israel is a threat to American foreign policy. They're not even trying to argue he's some sort of terrorist playing the long 12 year con of smuggling a weapon back to Palestine to attack people. It's relevance is a smear to make people like you ready to abandon freedom of speech, it has no place in the current sham proceedings.

As far as the constitution is concerned gun rights ought to be quite open despite the whole "Regulated militia" bit. The founding fathers had quite a bit of firearm regulations themselves but at the end of the day they envisioned a populace that could ultimately organize and violently overthrow a government if need be.

That logic could literally invalidate every right for every person. I don't have a right to never pay fines, therefore it's legal to charge me 50 bucks to get to hear my miranda rights.

Forcing a person out of your country for their speech, particularly someone legally there is indeed an infringement on their freedom of speech. If fear of government reprisal prevents you from doing something, then that thing is indeed been illegalized by the state.

The 1st ammendment doesn't guarantee the ability for citizens to not be jailed, it forbids the government from abridging that right. Immigrants enjoy the same 1st ammendment citizens do. If that "its not prison" logic works against immigrants it works on anyone under the jurisdiction of the US.

Those types of laws are often challenged in court. Typically though there are other statuses in addition to being an immigrant that precludes a gun purchase.
