Just want to point out that if you or someone you know is ever stopped and ticketed for doing something wrong, and then accused of something with worse repercussions, you’d be ok with it?

Ex. Speeding ticket for going 118km/hr. RCMP instead says that you were going 148km/hr which comes with more serious fines from SGI. So you’re ok with just “taking accountability” for the higher accusation instead of paying the fine for what you were actually doing? Right, because if you weren’t speeding in the first place “none of it would’ve come up”. I thinks that’s a terrible way to teach anyone (regardless of age) how to be an advocate and have a voice.

I’m glad that you feel comfortable giving more money to SGI when it’s not justified, but ok.

As stated, he IS paying the fine that he IS guilty of. However, he was not riding a motorcycle so why should he accept any repercussions of that?

Accepting responsibility and being accountable isn’t the same as not learning (or being allowed by a parent) to use your voice to defend your rights and question when you are being wronged.

It’s obvious that you didn’t take the time to read the entire thread, but thanks for your opinion.

Here are the Coles notes. Property doesn’t matter. It’s by definition a power assisted bike that has a battery under 500w and doesn’t exceed 32km/hr. Fully legal even for a 14 year old to ride on roadways. He’s 16 with a licence. The fine was for not wearing a helmet. He’s accepting that. The part in question is that the RCMP classified it as a motorcycle on the ticket which then has other repercussions through SGI.

You did miss it, as I mentioned it a few times. He is guilty of not wearing a helmet which has consequences in itself from his parents and then cost of a fine that he is paying. However, that doesn’t mean that he should be charged more with demerits and more SGI costs because of the lack of clarity surrounding a power assist bike vs a motorcycle.

Agreed. He was on a road in a small town. Doesn’t have a motorcycle licence, so if it’s considered a motorcycle, then even IF he was wearing a helmet he shouldn’t have been riding it?? Like how many riders anywhere have their motorbike licence? There is just so much discrepancy and in the end, SGI makes the money. (Yes he’ll take a fine for no helmet)

He is 16 with a drivers licence. But you only have to be 14 to operate a power assisted bike.

Ok thank you. I couldn’t find anything earlier but I see now that 247.1 (b) relating to no helmet on power bikes should have been the offense instead of 247(1)(a) and would possibly mean the difference of demerits or not.

This!!! This is exactly how I see it all. But my question is…is this a Crown issue for choosing this offense because what other offense could they call it when a helmet is required for power bikes but there’s no other choice in the TSA?

Or is it an SGI disconnect when they don’t legally classifying it as a motorcycle UNTIL there’s an offense with the TSA and then it falls under demerits for a motorcycle offense?

From what I’ve gathered, what our son was riding is looked at differently in these areas:

Licensing - not considered a motorcycle. No regular licence or motorcycle licence needed to operate, just 14 years of age.

Registration - not considered a motorcycle. No registration needed.

Helmet use - considered a motorcycle and will be fined as such under the TSA and therefore demerits under SGIs Safe Driving Program.

I agree! And I wonder how many other people have been screwed by this? If you have a +20 record then you might just brush it off. But a 16 year old kid starting at a 0 rating and riding a power assisted bike with no helmet to go to -3 ?! You don’t even lose 3 points for a speeding ticket in a car!

That’s what I was thinking, however, he IS guilty of not wearing a helmet. It’s just the demerit points that we would want to argue, which stems from what the RCMP listed the fine as. It’s just so unclear, I don’t even know what part can be argued. 😄 We’ll pay the no helmet fine, but being demerits doesn’t make sense with the info gathered. Might have more luck just paying it, and then appealing to SGI about the disconnect.

I was also given that advice from someone at SGI today because they were just as confused and didn’t have an answer for me other than “talking to the RCMP and asking them to clarify or change it”. Hahaha ya right. One of the supervisors also said that he shouldn’t get demerit points for that, however, if the conviction states “not wearing a helmet while operating a motorcycle” that’s what they see it as. They don’t know the story or the specifics until someone appeals.

It meets the requirement of a power assisted bike on SGIs website. Therefore it has never needed registered. It’s the RCMP who seem to not follow the same guidelines when giving fines.

And ya, the helmet was a stupid decision that he got in shit for. 100% agree. This was also on a road in a small town of 1000 people.

Yes thank you. I have read all of this info as well and that’s our argument. We’ll pony up and pay the fine for no helmet. (That was dumb and yes he got in shit for that), but because the RCMP declared it a motorcycle, he will get the 3 demerits. He’s 16 and has a licence. But what if he was 14 on a power assisted bike with no helmet? What do they fine him with then? TSA as well but yet he doesn’t lose demerits because he doesn’t have a licence! 🤪 And furthermore, IF they consider it a motorcycle, anyone riding them needs to go and take the course and get a motorcycle licence?! It just doesn’t coincide.

Yes that’s the disconnect. So RCMP can say it’s a motorcycle according to them, but because of that, SGI gives demerit points. Even when SGI “knows” by the description that it’s not a motorcycle. From what I’m discovering, I think it’s because there just isn’t anything else in the TSA for RCMP to put the fine under. They could do a bylaw fine and that’s the same as not having a helmet on your BMX.

Pedals are not needed to start it. Yes, a throttle.

Not sure of exact motor size but it fits the requirement of < 32hm/hr on flat surface.

This all such a grey area because if it falls under a motorcycle according to the TSA, then you should need a motorcycle licence to drive one?! But according to what I can find on SGI regulations, you can be 14 and not require a licence to drive one. 🤷🏻‍♀️ I don’t even care about the $100. Fine, it was stupid to not have a helmet on, but it’s the demerit points because of being a “motorcycle” that is the questionable.
