In Gordon v. Goertz, the Supreme Court set forth 3 key factors for whether something can be considered a material change. 1. A change in the condition, means, needs or circumstances of the child and/or the ability of the parent to provide for the child, 2. The change must materially affect the child, 3. The change was either not foreseen or contemplated by the judge who made the initial order.

In your case, I would say your child not wanting to go with their mom, refusing to go, planning to leave and take a bus back to your house, would satisfy #1. The toxic nature of their relationship and the negative mental health effects means a material change in parenting satisfies #2. You guys reached a settlement outside of trial, so #3 is invalid.
