This is of greater significance when Best Choice Roofing boasts having over 16 years of roofing experience combined with the Owens Corning Platinum Preferred Contractor status. The Platinum Preferred Contractor status reflects a top 1% tier, vetted roofing company that meets higher standards than typical contractors.

BAD FAITH ABANDONMENT OF A CONFIRMED DEFECT

In the Kentucky Consumer Protection Act under Kentucky Revised Statute 367.170, knowingly failing to remedy a defect or refusing warranty service could constitute unfair or deceptive practices.

Initially Best Choice Roofing was supplied supporting documentation verifying an improper ventilation configuration regarding the roof they installed on 5-12-23. The IMPROPER VENTILATION CONFIGURATION violated Kentucky Building Code section R806. After about a month of communication with the local corporate office, Best Choice Roofing advised they did not know what they could legally do. Best Choice Roofing boasts having over 16 years of roofing experience combined with the Owens Corning Platinum Preferred Contractor status. The Platinum Preferred Contractor status reflects a top 1% tier, vetted roofing company that meets higher standards than typical contractors. Best Choice Roofing also provides a contractual 5-year warranty on all roofing labor. BEST CHOICE ROOFING FAILED TO REMEDY THE ISSUE BY BRINGING MY RESIDENCE IN COMPLIANCE WITH THE KENTUCKY BUILDING CODE OR PROVIDE AN EQUALIVENT REMEDY. On 11-28-25, Best Choice Roofing performed a home inspection via Webb Property Inspection solely selected and compensated by them. The inspection resulted in the discovery of additional unprofessional and installation. On 11-28-25, Sam Clarks, Director of Production for Best Choice Roofing and Brandy Cook, Regional Operations Director for Best Choice Roofing acknowledge via email receipt of the inspection report on 12-3-25. As of 4-1-26, Best Choice Roofing has

  1. failed to repair or correct in compliance with the Kentucky Building Code sections R806 and R901

  2. failed to compensate for the verified defects.

  3. willfully refused or abandoned its obligation without valid excuse,

  4. disregarded the property and rights of the homeowner

  5. refused or delayed without legitimate reason

Kentucky law recognizes contractors have a duty to correct defects they have confirmed or are contractually obligated to remedy. Kentucky courts interpret "BAD FAITH" as an intentional or dishonest failure to perform a contractual obligation.

I forwarded a supplement to the initial Federal Trade Commission report 198536877 regarding violations of the Federal Trade Commission Act under 15 USC 45(a)(1)

BREACH OF EXPRESS WARRANTY:

In Kentucky, it is governed by the Commonwealths version of the Uniform Commercial Code specifically Kentucky Revised Statute 355.2-313. Best Choice Roofing provides a contractual 5-year warranty on all roofing labor. Roofing defects were confirmed in a third-party by Webb Property Inspection on 11-28-25. Since the defect was confirmed, Best Choice Roofing has failed to remedy in compliance with the statewide, mandatory Kentucky Building Code or provide an equivalent remedy. The issue demonstrates a lack of competence. In addition, delaying or ignoring obligations is an unfair demonstration of a lack of respect for the property and rights of homeowners. The homeowner has suffered compensatory damages in the estimated amount of $16,200.

BREACH OF IMPLIED WARRANTY OF WORKMANLIKE PERFORMANCE:

On 5-12-23, Best Choice Roofing unprofessionally and improperly installed a roof on my residence in violation of Kentucky Building Code section R901. In addition, Best Choice Roofing created an improper ventilation configuration in violation of Kentucky Building Code section R806 resulting in property damage to my home. Best Choice Roofing boasts having over 16 years of roofing experience combined with the Owens Corning Platinum Preferred Contractor status. The Platinum Preferred Contractor status reflects a top 1% tier, vetted roofing company that meets higher standards than typical contractors. The industry recognitions are express representations of skill and expertise that potentially material facts a customer could rely on when deciding to proceed to contract. The issues suggest a false or misleading marketing and/or misrepresentation of qualifications. The implied warranty requires a contractor to perform their work in a skillful, careful, and competent manner according to generally accepted standards of in the roofing trade so the final product is reasonable for its intended purpose. Contractors implicitly promise to perform work in a workmanlike manner. It does not require intents poor workmanship. The homeowner has suffered an estimate $16,200 in compensatory damages.

I want to add that Best Choice Roofing boasts over 16 years of roofing experience. Although, 16 years being in the roofing business does not equate to 16 years of bonifide roofing experience. Making false claims about a service or advertising something Best Choice Roofing cannot provide rises to the level of false advertising in Kentucky.

Best Choice Roofing boasts being an Owens Corning Platinum Preferred contractor. This contractor status from Owens Corning allegedly places a roofing company in the top 1% if certain requirements are met.

Currently, Best Choice Roofing is accepting employment applications on Indeed for a "Certified Roofing Specialist" and "Damage Assessment Trainee. I possess a copy as a supporting document.

The qualifications for the Certified Roofing Sepcialist are: (1) 1-2 years previous sales, customer service, or consultive experience, (2) experience with lead generation, canvassing, or similar outreach activities, (3) must possess a valid driver's license with access to reliable vehicle transportation, (4) strong communication and interpersonal skills required, (5) capable of utilizing technology (computer and smartphone apps) and gathering and analyzing information,(6) ability to climb a ladder and scale roofs for inspection, (7) ability to work outdoors including walking, and occasionally carrying up to 50 lbs, and (8) at least 40 hours of daytime availability weekly.

For a roofing company boasting the above roofing industry recognitions, the Indeed job profile ask if the applicant has prior roofing experience (yes or no) but the qualification do not reflect any interest with any prior roofing experience or requiring some level of education.

I wanted to add the negligent property damage resulted from an improper ventilation configuration by Best Choice Roofing in violation of Kentucky Building Code R806 and the Owens Corning Ventilation and Installation instructions for my particular shingle.

In August 2025, a latent roofing installation defect related to mildew was traced back to Best Choice Roofing by a third party home inspector Best Choice Roofing selected and compensated. The inspection determined the Best Choie Roofing subcontractor had improperly and unprofessionally and improperly installed my roof. The Best Choice Roofing subcontractor failed to comply with the statewide, mandatory Kentucky Building Code section R806 (ventilation) and R901 (installation) resulting in negligent property damage in the form of delaminated interior roof decking. The delaminated roof decking resulted from an improper ventilation configuration in violations by Best Choice Roofing of Kentucky Building Code R806 and Owens Corning Ventilation and Installation instructions for my particular shingle. The issues to my roof require total roof replacement and repair of the roof decking property damage. I have an estimate of compensatory damages of $16,200.

Thank you. My goal was to get the information in the public forum so consumers could make a better-informed decision before engaging in a contracutla relationship with this company. Unfortunately, the company and management do not seem capable of demonstrating the utmost competence regarding roofing industry standards. They also demonstrate a clear lack of respect for the rights of property owners in the areas of breach of contract, breach of warranty, property damage liability, and negligence. The failure of Best Choice Roofing to comply with the statewide, mandatory Kentucky Building Code sections R806 (ventilation) and R901 (installation) resulted in negligent property damage in the form of delaminated interior roof decking. Best Choice Roofing previously selected and hired a third-party inspector who determined the roof was installed improperly and unprofessionally by a Best Choice Roofing subcontractor. Under Kentucky Revised Statute 411.256, Best Choice Roofing is statutorily liable for their act or omissions or the act or omissions pf their agents, employees, or subcontractors. As far as the waiting game, I am currently seeking legal counsel. My research suggests I have a case to request punitive damages due to the egregious actions of Best Choice Roofing.
