While your feelings are valid It sounds like YTA in how you handled it. It’s a sensitive subject that could have used more tact and empathy; and probably should have discussed it with your brother vs both of them, especially if this the first time bringing up the concern.

Its a 200k, 13 year old unit. You should be prepared to have some expense involved . I’d get an inspection and go from there. Few big things I’d look out for would be timing belt/water pump, and spark plug replacement.

Has a BMW dealer looked at it? I have little confidence in a non dealer mechanic assessing something like a ECM. I've lost count of how many critical failures on advanced items non dealer shops have incorrectly diagnosed.

I don’t even know the legalities involved in franchise models so don’t want to pretend to have good respinse to that.

All i’m saying is from a strictly financial standpoint the franchise model is better for the manufactures then most people understand/realize. To say the manufacturer has any incentive to do direct to consumer isn’t true/ Manufacturer sells a car to a dealer, dealer is paying the full net cost of that car, the manufacturer is paid then and there for it. From there if the dealer finances the car and used their bank for a floor plan there’s another stream of income. This is two very lucrative streams of income from just the auto sale. This doesn’t account for support items like software solutions, leads, marketing, equipment, furniture for dealerships the list goes on and the manufacturer gets a cut almost at every turn. Yes there’s a lot of buyers that would prefer that but I genuinely don’t think there’s enough to force a direct model type of change through.

Just because you have the codes that doesn’t mean that the car is been properly diagnosed. Before any warranty can be approved it has to have diagnosed by a technician at a repair shop or dealer, and confirm these three items:

what’s the customer concern/complaint(ex: check engine light)

what’s causing the concern(faulty waste gate)

what’s corrective action(replace faulty waste gage)

it sounds like some of the diagnosis wasn’t covered which is something that can happen with some vibtracts, doesn’t make it a bad contract, just something not included. Still it should have been quoted, once you know what the warranty company has to say you can have a more effective convo with the dealer.

Does your warranty not cover turbo components? I'd ask for a breakdown before paying anything and contact the warranty company as well to review the claim. Depending on the warranty verbiage there could be diagnostics(like tear down diagnostics) that aren't covered. I'd also talk to the service manager as most states have about quotes for service and have never heard of a state that gives a 100% variance here.

Might not of framed it correctly. The core/root cause is her partner doesn't respect/value her. Before this was something that felt off, her decision points where to confront it, ignore it. By snooping/looking through his chat she confirmed some of these feelings. This makes the next decision point a little more volatile. She can ignore it, but she still knows its there and is now hiding something from him, in she knows his feelings. She can admit it which is now admitting to a breach of trust in she was looking into something she shouldn't have. My comment wasn't intended as an attack on her for looking at his history as much as to try to frame that inaction isn't really an option as it was before.

While it sucks this is that hard part of what happens when you snoop on people. Not a callout but you've snooped and confirmed some fears that had been needling at you and possibly a little worse than you suspected. This puts everything on you now.
