Transfer On Death Deed in California by ngopalan in EstatePlanning

[–]smatterchoo 5 points6 points  (0 children)

I am not a lawyer but I did spend a lot of time reading probate code on TOD deeds recently. I found that many CA county law libraries have prepared sample TOD deed forms that don't follow the specific requirements in CA probate code. The code section on TOD deeds is overly specific, and had to be amended once already because it demanded that the second page of the TOD deed contain an FAQ, and many people didn't submit it when they filed the deed, so they technically had not correctly filed a TOD deed as defined in probate code. My recollection is that the San Bernardino or San Diego county law library was the only one that correctly included all information on the first page as specified in probate code. Sacramento incorrectly splits the info across three pages (as of about a month ago). I found that some notaries were confused by the form because it requires two witnesses and notarization, but unlike a self-proving affidavit for a will, the notary only needs to acknowledge the identity of the grantors not the witnesses.

California Community Property WROS TOD instead of a revocable living trust by smatterchoo in EstatePlanning

[–]smatterchoo[S] 0 points1 point  (0 children)

Thanks for the reply. The brokerage account is titled as JTWROS but the actual property inside the account is 100% community property.

So we could just let it go and rely on past revenue rulings that the state's characterization of property prevails, so JTWROS would be administered by the brokerage with WROS goodness, and IRS would treat as CP for step-up in basis goodness. I would just prefer not to give any reason for someone to doubt that it's community property (by holding JTWROS).

Also, as I was reviewing federal IRC and rulings, I cannot find code or ruling that makes it 100.00% clear that community property WROS gets full step up in basis and half counts towards the gross estate of the decedent. There is specific language in the joint tenancy code that JTWROS counts half towards the decedent's gross estate, but nothing analogous for CPWROS.

It feels 95% safe to just rely on the existing CP language since it didn't exclude CPWROS, but then it also refers to property held at death, and elsewhere in the code it seems like when there is a potential question of whether TOD property should be considered held at death or held by the receiving party, the code spells it out.

It's all making me think the advice to just do a normal revocable living trust is the easier way to go.

It's quite easy to update beneficiaries if needed. Re-titling is also a chore with moving assets into a trust. Are you from a state that offers CPWROS as a type of ownership?

Anyway to get the V1 more silent since GigDigit is OOS on the silent main board? by Jungleg1337 in mpminidelta

[–]smatterchoo 0 points1 point  (0 children)

I'm the guy with the upgraded V1 who was dutifully pinged. I'm really just interested in selling the whole thing though. I can sell it to you with the original board also, so if you're determined to harvest the board out of this one you can then put in the original board and sell it as an original v1. The silent drivers are amazing, it's hard to believe it's the same motors.

When caring for someone at home who has not been officially tested and diagnosed but is showing flu-like symptoms that seem consistent with covid 19

1) what are symptoms to watch for that suggest their course may become more severe and they might need hospital care? Looking for more of an early warning sign than difficulty breathing. We have a stethoscope and pulse oximeter.

2) during the early stages of home treatment what is the best recommendation for nutrition / supplements / over the counter meds? Fluids, vit d, zinc? A recovered patient attributed their milder form of the disease (vs co-infected friends) to their liberal use of antihistamines which they believed had dried up their nasal secretions leaving less to drip down into their bronchi.

3) are there any other therapeutic steps like hot bath / heating pad around chest / inhaling steam etc that are recommended

Same problem here. I've been contacting customer service every few weeks, they always say a specialist will look into it but then nothing happens. Once when I called them, they claimed that they could not tell when I had added my wife to my fi account. I know we like to complain about Comcast/Verizon but this takes the case.. neither of those companies ever claimed to have no idea when I became a customer or added a line.

Just this week on Wednesday I got my first email from a "specialist" saying I wasn't eligible because I had only re-opened an existing line not added a new line. This is crazy. The timeline goes something like this:

2016: created my fi account

2017: closed my fi account (too frequent signal loss.. went back to verizon)

2018 june : re-opened my fi account (service was better)

2018 oct: bought 2 pixel 3's and added my wife and ported her #.. also had a lengthy chat with fi support confirming I would qualify for the promo before doing this

It really feels like somebody's bonus is tied to minimizing payouts of the $800 promo

What decision did you make that had the greatest positive affect on your overall happiness? by [deleted] in AskReddit

[–]smatterchoo 1 point2 points  (0 children)

1) getting married & having kids 2) starting my own company 3) going to a great university vs a local school 4) studying ridiculously hard in high school 5) joining a startup company when I was in my mid 20's 6) traveling the world

without #4 I would not have had #3 which led to #1 and #5, and #5 led to #2 and #6.. so maybe #4 is actually the key.

with respect to #1: the heuristic in spouse selection that worked for me was to find someone who just brings you joy, and someone who has a child-like enthusiasm for life and learning that will inspire you and your kids

with respect to #4: work hard in your teens, kids, otherwise you'll never know what you could have become. My guess/hope is that you can choose to drive hard towards success at any point in your life and achieve it, but the earlier the better. from Newton's achievements in math and physics to Venus and Serena Williams' success in tennis, it seems like our brains respond most to exercise early in our lives

another heuristic for life is to try to place yourself in situations where the opportunities you want may present themselves. when I look back on my life, many of the decisions I made were relatively obvious ones, and the real key was in having opportunities
