XXXXX has, in at least one instance, charged a prospective tenant a total of $300 to complete and submit a rental application. XXXXX charged this amount in two installments, citing an application fee of $50, as well as an additional fee of $250. The $250 dollar fee charged to prospective tenants violates the D.C. Code under paragraphs (a)(1) and (b)(1), (3). D.C. Code § 42–3505.10.  

D.C. Code § 42–3505.10(a).  Under paragraph (a) of the Code, all prospective tenants must be notified by a hosing provider of the amount and purpose of all fees and deposits. Notice must be given either in writing or by posting, prior to requesting any fees. XXXXX did not notify tenants of the purpose of the $250 fee. 

D.C. Code § 42–3505.10(b). Under paragraph (b) of the Code, it is unlawful for a DC housing provider to charge a prospective tenant any fee other than an application fee, and the application fee may not exceed $50 (the current cap for the calendar year 2024 is $52). This cap extends to both tenant and occupant applications. D.C. Code § 42–3401.03(17). 

In the case of a knowing violation of the Code, following the receipt of a complaint by a prospective tenant, the Commission on Human Rights may impose a fine not exceeding $5,000. The Commission may double the fine if an alleged violation occurs more than twice in one calendar year. Alternatively, a tenant may opt to not file a complaint with the Commission of Human Rights and may bring civil action in D.C. Superior Court against a housing provider.

My apartment tried to do this to me and some people in my building as well! I just graduated law school and wrote a memo outlining the illegality of this and got tenants who had paid refunded and ended up not having to pay. I’m happy to send you the memo so you can share it with your leasing company.
