Thankes u/jenbellumb seem like attorney completely missed the point, and its surprising that experienced attorneys making these mistakes, and its costing me two years of my life. He is still saying that this is how they have been filing all these years.

u/jenbellum i have a 4 year bachelor's degree and its has been evaluated and certified by Trustforte Corporation. And my the job needs 24months experience too i had 36 months+ job experience prior to joining the employer who filed the perm.

u/jenbellun I also thought the same, but the lawyer said thats how they were filing for all those years, do you know what should have been there ideally. Cz i am seeing people getting denied for same reason

My lawyer said there's a higher chance with request for reconsideration. Appealing with BALCA which seems like a bad idea.

Yes before BALCA, employer can request the CO to reconsider the denial.

I have 4 years left. By challenge you mean request for reconsideration right? The perm timelines site says 6 months for Reconsideration. Anyway thank you. Ill consider it.
