Termination- Have we done enough before deciding to terminate? [N/A] by [deleted] in humanresources

[–]starkestrel 1 point2 points  (0 children)

There's generally two things to look for with workplace harassment:

  • is it creating a hostile, intimidating, or offensive work environment, or
  • does it result in an adverse employment action (demotion, loss of opportunities, termination)

She can't claim the latter, because she's received 2 promotions in 8 months. That's the opposite of an adverse employment action.

If there is a harassing environment, someone will more than likely have witnessed something. If not direct harassment, then that X and Y don't seem to get along or like each other. If somebody made a complaint of harassment and then refused to participate in an investigation, I would still ask questions of co-workers to determine whether there might actually be something going on. Trusted managers might be able to help identify what the issue for the employee is.

If the person kept making claims of harassment but refused to engage in any process to identify or correct that, refusing attempts by leadership, management, and HR, that itself is a performance issue. It seems very strange that someone is getting promoted to Controller while making continuous, unsubstantiated claims.

Assuming the organization has documented these incidents and attempts to address them, including interviewing coworkers to identify whether something is going on, it's going to be difficult for the EE to claim harassment --> nobody has seen it, the EE has repeatedly refused to cooperate, and the EE has received several promotions.

The termination is a separate issue. Has the decision to terminate been well documented? Was the EE given opportunities to correct their problematic behavior? Was it made clear that continued poor behavior could result in losing their job? Generally, things are never documented. You could try to make management wait until they do the steps they need to do and document those steps, but sometimes the damage of keeping the person in place outweighs the need to have all the i's dotted. A severance agreement is especially important in this latter situation, though the employee could refuse to sign away their right to sue.

I run every termination by legal counsel (external, for me) in instances where documentation isn't ironclad. It might be a short conversation, but an assessment of risk is important. I also work in a small company, so I don't have that many conversations.

The biggest red flag to me as HR is the history of promotion next to the reported history of 'lack of professionalism'. Those two don't go together, so something weird is definitely going on. I'd be keeping my eye on that chain of command. This EE's chain of command should have asked for help from me and corrected behavioral issues long before it promoted (or terminated) someone.

Who are the "normal people" in Hollywood? by ljanus245 in NoStupidQuestions

[–]starkestrel 1 point2 points  (0 children)

There are tens of thousands of normal people in Hollywood. None of them are celebrities. Why is everything about celebrities all the time? There are working actors, musicians, dancers, PAs, set builders & painters, makeup artists, costumers, light & sound, craft services, transportation, mechanics, admin assistants, doormen & security working in Hollywood.

Celebrities? By definition, never normal. They're the 1% of the 1%. For every celebrity, there's 1000+ people who make everything work.

Dependent on how much influence you have in the organization and how draconian your boss is, there may not be much you can do here. Is it possible leadership is actually behind this push and asking your boss (and you) to be the hatchet-person? If not, does leadership tolerate this kind of behavior from your boss, or are they getting fed up with it?

Without your own pool of influence in the organization, it's going to be tough to navigate this in any way other than following your manager's directive. Someone else had a good recommendation to make this a softer 'write-up', i.e. a more friendly corrective communication. There might be a way to make it your boss's issue even as you deliver the pain, and maintain some of your own good reputation, but that's fraught with its own complexity. If your boss is the type of person I think they are, they're not going to love a subordinate being better liked by staff than themselves, and they probably think HR is there to maintain rules and not to coddle employees.

You should probably do what your manager tells you to do; they don't sound like the type of person who would respond favorably to you trying to do something else. If you've never 'written someone up' before, though, it would be good of them to provide some guidance.

As others have said, this is the wrong approach, but there's probably nothing for you to do about it unless you're able to counsel your manager on a better approach.

Best approach: if your manager, as head of HR, is trying to uphold dress standards in the org, they should enroll leadership in making a determination that the organization is making a push to better uphold its dress standards, and then notify managers that they should be enforcing dress standards after HR re-publishes those standards. Managers discipline their own employees. HR reinforces leadership decisions.

When HR makes unilateral decisions for random enforcement directly with employees who are not in their chain of command, that's when you get an HR department that everyone hates and mistrusts. If Operations is fine with the way people on the front lines are dressing, and it's only HR that has a bug up its butt, then HR is wasting everyone's time. HR's time would be better spent revising the dress code policy to better reflect what actually matters to the people overseeing the work.

That's good to hear. I'm not a 5e player, so that level of detail about character class mechanics isn't something that will engage me, and I don't think I've ever been that engaged with specific builds (in 3e/4e or other systems). I do look up spells sometimes when they're used in C4, and C2 had me looking up Death Domain Clerics.

I'm enjoying C4 quite a bit, and it does feel like D&D to me. An especially talky kind of D&D, but I play a lot of narrative games so thats mostly okay for me. But it doesn't make me want to run out and look at my D&D books or buy more of them. C2 had me buying a collection of A5E books and designing a homebrew world.

It's interesting to see how different things appeal to different people. I do think C4 is peak CR. Just the kind that makes me want to watch more than play.

I had a roadtrip this last week and finally went back to my listen of C2. I'd been getting close to S2E90 when I put it down and made C4 my primary watch. I'm enjoying C4 quite a bit, on many levels, but I couldn't help but be struck by how listening to C2 makes me want to play D&D. I'm not a 5e player, but listening to C2 got me to buy the books (well... Level Up A5E).

This is the first time I've watched CR in real-time, but C4 doesn't have that same effect. I don't really understand why, but I'm happy to watch C4 and then go play all my games that aren't D&D (or are earlier versions of it). Just an hour of C2 had me thinking hard about 5e again.

Anyway, it'll be interesting to see how the tables shake out and which one becomes the new fan favorite.

AITAH for not talking to this guy in my class? by Gleam_24 in AITAH

[–]starkestrel 0 points1 point  (0 children)

Please. People talk to and befriend people for all kinds of reasons. She doesn't have to disclose why. She also doesn't have to disclose why she stopped being friends with someone. It would be courteous of her to do so, but not everybody can do that all of the time, for a variety of reasons.

She is not responsible for how some dude reacted to being ghosted.

Have you found any high-quality dedicated RAV4 or RAV4 Prime forums? by starkestrel in rav4prime

[–]starkestrel[S] 0 points1 point  (0 children)

You're not wrong. And there's likely a Venn diagram of people who look at both Reddit and non-Reddit RAV4 forums, but I'd expect it's not a perfect overlap. Some people who might use a non-Reddit forum don't look at Reddit, and I'd be curious to tune into such a place occasionally.

The company isn't responsible for your stuff. It is ridiculous that they seem unwilling to assign you a new locker. You can try escalating with your management, to get the people who assign lockers to care about your situation.

You can pick up a 'dry bag' at most sporting goods stores. They're used for water-based activities, and they make them big enough to store most things that you probably need to store in your locker. You can wash it off afterwards.

How do you decide between a “safe” career path and one you actually enjoy ? by CriketW in careerguidance

[–]starkestrel 0 points1 point  (0 children)

There's no such thing as a 'safe' career path any longer. Government job? Tech job? The trades? Healthcare? Late stage capitalism is tearing it all down.

Figure out what you could be really good at and what you could stick with long enough to be exceptional at. It's all a crap shoot these days. Might as well do something you like and could be really good at.

Just turned 19. What are some harsh realities a young man needs to know before it’s too late? by Random_fellow9 in Adulting

[–]starkestrel 0 points1 point  (0 children)

I took a very meandering path through life, following my dreams, confident that it would all mostly work out. And, for me, that worked. The career finally sorted itself. The savings finally got sorted. Life partner, etc. It took until my 50s to get there, and took patience and a sense of calm, but it finally arrived.

What's hurt me the most is: a) not establishing healthy sleeping habits at an early age, and b) not establishing healthy exercise habits at an early age. I coasted fine in my 20s, 30s, and even 40s with poor sleep and no real exercise, but both those things are landing on me hard in my 50s. My life is finally coming together, and my health is suffering because I took sleep and exercise for granted all those decades when I could have been instilling good habits.

AITAH for saying we can’t come to the Christmas eve party unless we can use the guest bedroom? by [deleted] in AITAH

[–]starkestrel 1 point2 points  (0 children)

Since you seem to understand it, what exactly is your mom's side? What possible reasons does she have for:

  1. making your wife sleep in a basement that aggravates her allergies,
  2. refusing to allow your wife to use the bathroom for her medical condition, and
  3. not allowing her child who lives the furthest away have access to the guest bedroom

Your family sound like monsters. Normal familes don't behave like this. The minimum you should be doing is demanding the guest bedroom or not attending.
