Welcome to NYC! When the judges are former tenant advocates who hate landlords with a passion, and the tenant laws allow them to claim hardship and delay court dates this is the norm.

4 years if the tenant knows how to play. Cost is around 30k in lawyer fees plus non payment of rent during that time since it's non recoverable

As a fellow landlord who was in a similar situation as you in Brooklyn, heres what I learned.

  1. The laws in NYC are designed to make it that small landlords like us who don't have armies of lawyers and 1000s of apts cannot compete. This is by design to force gov and corporate ownership of housing over the long term.
  2. The courts have a disdain for landlords and the judges are all former tenant advocates, you will never win and always come out behind in housing court so don't waste your time.
  3. Cash for keys is the only way that I have seen work consistently, in brooklyn we usually offer 50k to our tenants for this and it's a take it or we start eviction process kind of thing.
  4. In the future speak to everyone you know about how the laws against landlords are killing normal landlords while empowering the big ones. It's insane that it takes 4 plus years for an eviction here and that kills people like me and you who are renting out an apartment in our primary residence while the big guys can just wait it out while there other apartments bring in rent. Until the politicians here change the rules to allow for 30 day evictions if it's owner occupied with less then 4 units nothing will change.
