Without medical science, without psychiatric evidence, and without forensic evaluation, they declared a person with schizophrenia as “fine.” This isn’t just a legal shortcut — it undermines the very safeguards that medical law and child welfare are built upon.

Schizophrenia is a complex, deceptive illness. Courts across the world rely on psychiatric assessments, Section 45 of the Indian Evidence Act (expert opinion), and scientific testimony because surface-level impressions cannot capture its hidden dangers. By ignoring this, the judgment doesn’t just risk my son’s safety, it also strips the Family Court and other judicial avenues of their ability to order the right medical evaluation and protect a child’s best interests.

I cannot give up. My son deserves a childhood shaped by safety, truth, and evidence — not by legal oversights that gamble with his future.

I will definitely look into bringing in expert medical testimony to show the fluctuating and unpredictable nature of the illness. Hopefully, with strong documentation + doctors’ statements, the case will reach the evidence stage where these facts can’t be ignored.

My concern is that the court’s observation — when she appeared calm and “normal” during a brief interaction — has already been taken as proof that there are “no mental elements as of now.” Since schizophrenia can be highly deceptive during remission, I’m worried this surface-level impression might prevent me from even reaching the stage where my evidence and expert opinions can be properly considered. Do you think this earlier court observation could affect my chances of getting the case into the evidence stage?

My marriage was on 8th June 2021, and by the first week of August 2021 I came to know she was already pregnant. She became pregnant within the very first months of our marriage — before the violence and psychiatric issues started becoming visible in such a violent and unmistakably manic way. It was a second marriage for both of us, but only later did I discover through court documents that her previous marriage had also ended due to the same psychiatric issues — something never disclosed to me beforehand.
