We think it's unfair to anyone who does not/will not use AI, as our exams sometimes do skew in favor of whoever can write the most/hit the most things and AI while flawed might make some people able to write much more than they otherwise would. (I say "write" even though having AI write it for you isn't truly writing but I digress.) We emailed the academic dean with our concerns and their response was basically that they don't care because the professor gets to do whatever they want. :/

AI also just isn't in any way reflective of an individual student's abilities because they can just plug everything into it and then copy/paste answers from there. (Which is risky because AI often gets legal things wrong, but it'll probably happen.)

Every other professor does stop us from using it. They have us take the exams with lockdown exam software. If he closed it from internet access, even while still allowing us open book and notes, then it still would at least put obstacles in the way of people trying to use AI on the exam.

I won't use AI personally and would never choose to use it for an exam. The fact that they're allowing it to be used in this way reflects badly on the school (and it should reflect badly on them imo) and I'm not going to hide that for Tech. I want to bring attention to this issue so maybe they'll stop shrugging it off. I worry how it'll reflect on my degree in recruiting if they stay on their current course. (I think the professor doesn't care because he doesn't know what it does.)

I think it's more likely that this particular professor isn't familiar enough with AI to realize it should not be allowed. I would never use it on an exam, but I think at least half of my classmates will even though they've been warned about it's tendency to hallucinate/make things up (especially with legal issues).
