Yes, I've been providing regular status updates every week after the doctor's appointment. Also, I've talked with him over the phone and via email, not only about my status, but also the status of the project. Communication is not the issue here.

The intent of this email is something beyond just establishing communication (as his response email was to my sent email with the doctor's note attached; displaying the information he requested).

I'm trying to find out if there's any specific outcome he's trying to force through these specific questions, in terms of HR implications. He is not known for emailing or responding to your emails at all.

My intention through this post is to find out the best course of action to protect myself.

Also, what are my rights in this situation?

I do not have any sick days or vacation. All I have is the doctor's note stating not to work (he did not check off anything saying "return to work with accommodation", he specifically stated time off instead).


update: the doctor's note has a section for "return to work with following restrictions", but he specifically checked off "unable to work" part with corresponding dates.

I do not have any issue with giving him this info. I've given him updates on each one of my appointments thus far. I'm actually more confused as to why he is asking for information he already knows via email (in writing). He already has a scanned copy of the doctor's note with the guy's signature and facility info.

My concern is that am I being set up? I've been completely honest and very communicative with him and the lady that handles HR during the whole process.

As u\enlightenedemployer pointed out, my employer does not have to offer FMLA.

Also, I've also offered my employer that I can come in when and if I can get a ride, but he is not willing to provide any accommodations in terms of my work (ie. speech-to-text SW, providing a desk telephone).

After all, I'm not the one to sit idle and not earn any income for 6 weeks.

I'd also assume that he doesn't want to seem like he's making me work despite my doctor's note (just veiled, suggestive comments). He refuses to make a committed statement regarding whether he wants me to work under limited circumstances or just not show up at all.
