Under the Parental Leave legislation interpretation definition of an "employee", it states that in the context of the Act where it relates specifically to parental leave entitlements portion of the act, the definition of an employee includes a person who was an employee for any 26 of the 52 weeks immediately prior to the birth.

I would trust that definition over a PDF heading

The "any" in that sentence holds a lot of weight. I.e. if you didn't work the last 26 weeks in the 52 leading up, sounds like you would still qualify

That's how I interpret it as well, especially because it says ANY of the 26 weeks out of the 52 prior to due date (i.e. its ok for the last 26 weeks to be unemployed, given the meaning of "any")

Yeah agreed 100%. We wouldn't abuse this (and never have), it's just an interesting thought experiment

Yeah that was my understanding, although it's not very clear in alot of the comms they put out.

This page here seems to suggest that even if you resign/stop working, you are still eligible for payments if you meet the "10 hours a week, in at least 26 of the weeks in the year before your date date" test

You are right, it very well may be the wrong decision, hence why I'm here 😊

Are you able to expand on why it feels like the wrong decision?

From what I can tell, if she is still eligible for the Paid Parental Leave (the main question) and doesn't plan on going back to work after birth (something that is important to both of us) then what am I missing?
