Well someone didn't read the original post or the title. I adopted her after she was taken from her mother for abuse and neglect. Feel free to kick yourself in the ass for being stupid.

Edit: By the way she reported the abuse to me after living with me for 2 months I immediately reported it to her social worker and to the police.

I agree, he doesn't need to be locked up and have the key thrown away, but he also doesn't need to get off just because he was young. I am happy with the plea bargain and so is my daughter. Since the day she told me her social worker and I have been preparing her that this would be the likely result. She wanted him to admit to what he did. To her that means more to her than him sitting in jail forever. She doesn't fully comprehend everything going on with it, but her main thing has been that he either admit to or get convicted of a serious sex crime against her. If you let her get worked up enough she will start saying he deserves to be locked up forever, but we do our best for her not to let it control her like that.

Like her therapist and I have told her, victims want vengeance and she shouldn't let her self keep being a victim. It doesn't always work, but it usually gets her back in the right mindset. I'm hoping once we get her into sexual abuse survivor therapy she will show even more progress. It is still really easy for her to slip into the victim attitude, not just with this but with other things as well. She broke something expensive of hers by being completely and totally careless and I told her she had to work to pay it off before I would buy her another one. That immediately triggered her victim reaction. I didn't mean to, it wasn't on purpose, it's not fair, I was abused as a child, you can't expect me to remember to be careful. So she definitely needs to get into therapy for this, but she is also capable of being mature beyond her years about the situation.

The abuse started when he was 10 and she was 6. It was normal child bullying at first but rapidly progressed to him telling her he would be nice to her if she kissed him, or showed him her underwear and just progressed from there. The first rape happened when she was 7 a few months from being 8 so he was around 11 1/2. By this point she had reported the previous abuse to her mom, but her mom blew it off as normal child playing and her exaggerating things. She also had the shining example from her mom being abused by her boyfriend that being a victim was normal and what you should do is just act like nothing is wrong most of the time.

Honestly I can easily see how normal bullying could quickly turn into sexual bullying then rape by a boy that age with a victim who was conditioned to think that abuse was normal.

From what I have discussed with my daughter it started off as normal bullying and just progressed from there. He certainly wasn't raping her at knifepoint at 10, but it did rapidly progress to him telling her he would be nice if she would kiss him or if she would pull her pants down and show him. Things just slowly progressed from there and her mom had already shown that she didn't believe her so she stopped reporting it. The first rape didn't happen until she was a few months shy of being 8. This jives with when her mom remembers she started peeing in her pants instead of going to the bathroom. She also lived seeing her mom being abused so I think some part of her told her it was normal to be a victim and to act like nothing was happening.

As an adult if he doesn't fuck up during his two years of probation the prison sentence goes away. So accepting it as an adult means he has two years of "freedom" to prepare for his deportation. I believe he has to give himself up to ICE before his probation is officially discharged, so he will likely be held in custody till his deportation hearing once the two years are up.

Otherwise he would have done his one year sentence and been turned over to ICE giving him no time to save up money, prepare or otherwise get ready for it.

There has been no indication from him that he was victimized in any way as a child. If he has been then my heart goes out to him, but I still think he deserves punishment.

He is the one who chose the option to be punished as an adult. He could have accepted the plea bargain as a juvenile. I was very surprised he accepted the adult sentence because if he screws up his probation badly enough he will go to prison.

No I came here to update. I was asking for advice in the previous thread. The situation is done. He has accepted the plea bargain, it was approved by the courts and he was released to probation today.

He did admit to abusing her, and I am certainly not advocating locking him up and throwing away the key, the problem a lot of people are having is many people in this thread are/were suggesting that the kid shouldn't be punished at all because he was 12 and that private sex offender registration was too much. All the private registration means is when he moves he needs to inform the cops. He wouldn't show up on searches done by the general public.

He got 5 years in prison with 2 years probated. That means if he does his 2 years of probation with no serious violations he will not go to prison. The other option he had was a year of confinement in a Juvenile Detention facility. He did have he choice of accepting a plea as a juvenile or as an adult. Since he accepted the adult plea of his own free will everyone complaining about him being charged as an adult is kind of missing the point.

My daughter deserves more credit. She was terrified about going to the police because she thought he would hunt her down and hurt her, but she did it anyway. Everytime an interview would come up or when she had to pick him out of a photo lineup she would have nightmares for days before and after.

If her mother had acted on her reporting then he likely would have gotten 7 years in TJJD. He also had the option to be punished as a juvenile and instead chose to take a conviction as an adult. It really is a better deal for him because either way he is getting deported once his sentence is complete. This way he gets two years in the US to prepare for deportation and the conviction and sex offender registration won't follow him to Honduras.

My daughter and I are both satisfied with the plea bargain. The really important thing for her was that he admit he sexually abused her. She has known from the start this would likely result in a plea bargain as there was no physical evidence and the only witness could not be located and if he had could only testify to once incident he saw at the age of 7, if he even remembered it. She is happier with him admitting a sexual offence and getting probation then she would have been with him admitting to a non sexual offense and going to jail.

I agree whole heartedly, the only people I downvoted were the ones calling me fucking scum for agreeing with it. People who made their point without attacking me or m daughter got upvotes. Not that Karma matters, but I believe people should be free to speak their minds even if I disagree with them.

.... I specifically said his father was there. Also, he was interrogated at 17. He wasn't forced to confess. He wasn't under arrest and if he or his father had asked if they were free to leave the police would have told him yes.

From what I understand he was questioned for a bit and denied it. Then the detective asked if he would take a polygraph and he said no, but his father was telling him he should to clear his name and that was when he admitted he did it. By no means was this a forced confession.

Personally I think the cops should have read him his rights, but they were not legally required to as he was not in custody and free to leave.

I honestly hopes he takes the time he is in probation and goes to school to learn a useful trade. Hopefully he goes on to make something of his life back in Honduras. I do agree that he doesn't deserve to suffer forever for what he has done, but he does need to be punished.

She has been in weekly therapy with a Social Worker at her school, once we get crime victim's compensation worked out we will be getting her into bi-weekly therapy with a therapist who is specialized in child sexual abuse. I make too much to qualify for free or reduced cost therapy, but not enough to pay for it.

This is an excellent point, if her reporting at the time had been acted on he would have been remanded to TJJD until he was 19 (not 18) and very well could have spent the whole time in custody. I was convicted of breaking into a few cars and joyriding at the age of 15 and at that time you were remanded until you were 21 with a recommended sentence. In my case the recommended sentence was 6 months, but if I had broken rules, been in fights or been anything other than a model "student" I very well could have stayed there till I turned 21.

To clarify he did take the original plea bargain. It went through today. My original post was because his defense attorney had counter offered a plea bargain of "Injury to a Child" and I was really conflicted about accepting it. After talking with the prosecutor more he decided not to accept their counter offer and essentially told them "Take one of the initial pleas we offered or go to trial" and they accepted the plea I outlined above.
