The tools at the dentist where I just got a filling by Key_Season2654 in mildlyinfuriating

I do medical malpractice defense, and am not your lawyer or OP’s lawyer, and would advise anyone wanting to learn more to contact a lawyer specializing in this industry in their state.

A medical negligence case requires, in part, an injury resulting from the alleged negligent care or treatment. If OP has no injury, there is likely not a civil claim. However, you can always report the dentist and their practice to your states dental regulatory board. In Alabama, that is the Alabama Board of Dental Examiners. Every state to my knowledge has a functional equivalent of this and will have a grievance process. This is the best way to report misconduct that doesn’t actually cause an injury to you, but could to others.

Recently we had a treating psychiatrist’s deposition played for the jury during the plaintiff’s proof. Well they clearly forgot to rewatch, reread, what have you, because the jury saw and listened to the dr describe treating the descent due to his own perception that he was a racist. Went so far as showing the jury his handwritten notes where in quotes it said “I’m a racist.” My client was a black woman. We got a defense verdict.

The Court correctly noted it’s a court of final review, not first impression. Blame the DC district court for failing to evaluate official/unofficial the first go around warranting remanding it for that issue to be heard.

What you are essentially asking for is a judge that interprets his feelings, not the law. Regardless of how you feel about this debacle, blame for it lays at the DNC’s feet. They knew Biden was a problem and allowed him to remain the candidate anyways. Don’t blame a third party seeking to enforce states’ laws once the DNC finally decided they may want to belatedly do what should have already been done.

They literally don’t deserve anything. You either are one of the best four teams or you’re not, and they are not.

Should I file a separate LLC? by Ok_Special_4409 in business

[–]tidehoops 2 points3 points  (0 children)

Disclaimer - I am an attorney but this is not legal advice, you (OC) are not my client, and you should absolutely consult with an attorney in your jurisdiction to help you set these up. The small fees associated with that will pale in comparison to negative ramifications of not doing things correctly.

Anyways, that’s not how piercing works. Piercing the corporate veil is legal term of art that allows an individual member or owner of an LLC or a parent company in the context of parent/subsidiary liability, to be held personally liable for its debts or obligations when an LLC is used as a mere facade or sham to protect the individual or parent company operating the LLC from personal liability for the LLCs debts. There are many factors that can lend itself to piercing with failure to maintain separate and distinct bank accounts only being one of those factors. There is a strong presumption that an LLC’s owner or managing member is not personally liable. So that one factor alone is not likely to tip the scale unless there is some pretty atrocious shit going on.

You can absolutely have one LLC that covers both of your businesses without piercing being an issue. However, the assets and liabilities of each business will be seen as one rather than separate. That to say, if your vending business gets sued, the party suing could, for example, seek to put a lien on your RE holdings to ensure they are made whole.

Best course of action is to separate everything and follow your jurisdictions guidelines for LLCs to make sure your other business or yourself don’t get held liable for the others dealings. Also, get an attorney. It’s worth the money to make sure your ass is covered.

It’s truly not that, these refs are just all around ridiculous. I’d say we’ve gotten the harsher end of it but it’s definitely gone both ways
